H-1's are vital to our economy and it would never work to give work visas to people half a year after they apply, the job would go unfilled for that long and eventually those companies that need those people would offshore the job to wherever the people are that can do it.

I don't buy that. I think bringing in someone, who is going to live here, permanently and pay taxes permanently, and be a part of the US economy permanently, that would be more beneficial in the long run than having someone come here to work.

You'd think the government would much rather have more potential citizens and fulltime taxpayers rather than temporary labor. Apparantly not.

You would think that would be the case. But what they were saying is that with all the red tape involved to MOVE someone here permanently, businesses can't wait. They need the worker today. Not in 6=12 months. So the H1 visa gets them the worker NOW. Im not so upset that USCIS is prioritizing the I485's over us because those people ARE HERE..and WAITING to find work and CANT till they get that EAD. THAT can cause a financial strain on families. How would we feel to get our SO here...then be postponed getting a job because the I485 is behind. I"d be infuriated. MOre than now. Soooo, stands to reason they made THAT the priority. Dont confuse what USCIS is doing...the H1 is NOT the priority. The I485's are.

Now what BUGS me is that their site THEN says...AFTER the I485 the next priority is those seeking citizenship.....HUH???? Come on... those people ARE here...they ARE working....WHY is that the next priority? This isn't an issue of USCIS being indifferent..this is an issue of the governments poor planniing, and poor preperation...we aren't the ONLY time in immigration this has happened to. I found articles of slow downs in 2005, 2003 and 2000. So its NOT the first time..wont be the last.

If this was YOUR business and you have a steady work load..then SUDDENLY you get to much work...do you jsut run out to hire people? No. Thats not cost effective..you work overtime, you work harder, you prioritize. Then when you are caught up...the workload goes to normal. Flucuations like that happen in business all the time. AFter USCIS gets all this caught up...if they hire more workers SIMPLY to catch up...what happens to those workers AFTER they catch up when its normal again???? Is it really the wisest thing to hire more JUST to make it through a hard time? If I was in charge...I'd say no. I dont want to lay off workers and affect even more families.

Im not defending how long this is taking. As Bill states..Im being realistic. Personally I think the workers are doing their best. Is the system broken? Yes to an extent. But is it just possible that our emotions are running high...because we want our loves here...we are emotionally spent?

I think the priorities they are referring to is only re receipting. They have a receipting backlog as well as a processing backlog. I haven't read anything about processing priorities other than the 2 month and 15 day timeframes for certain applications. And of course what we see is happening with K1s.

As far as the NEED of business for H1B visas I have to interject something. Agribusiness needs migrant workers because Americans won't do it at THE WAGES THEY WANT TO PAY. Same goes for many other jobs as well. They outsource writing computer code to India because it's CHEAPER not because it can't be done here. That's behind a lot of the H1B visa stuff. Have to recognize ulterior motives to these people and what they say. Alan Greenspan even advocates for more H1B visas as a way to "tamp down" rising american wages in skilled positions cause somehow that's bad. Funny how they worship supply and demand until it comes to paying people? :bonk:

I have to agree...very well stated. The migrant workers are usually paid much less. (My cousin doesn't do this....they pay well, give housing and feed them as well. But then they have been very successful due in part to those migrant workers..so they take good care of them..but I understand not ALL do)

Hello everyone!!! Another weekend....:( Anyways, at least now we know VSC got Byron's paperwork back :-) Maybe we'll hear some good news over the weekend otherwise we'll start a good week on monday!!!

Thanks Byron for your wishes!!! I hope my approval comes very very fast! :-)

I want you to take a look at this link....it's about and immigration officer who used to work at NSC and filled out an I-129F for his fiancee and he talks about the process of applications....anyways, his name is HUSKERKIEV and read post number 43, paragraph 6. He talks about RFE's.

http://www.visajourney.com/forums/index.ph...55762&st=30

I'm sure your approval will come very soon Byron!!! Let's keep thinking positive :D

WOW, I actually got a touch, it says that they received the requested evidence ( a missing signature on a form) and that now the case processing has resumed....it says i will be notified by mail within 60 DAYS!!!!!!!!!!!!! .....Please tell me that this is just due process and that it really doesnt take that long!!!!!!!!!!!!!!!!!!!!!!

I think this is just standard notification. Let's hope for aonly a few days. Good luck Byron!!! This is it.

Holy Cow!! My projected adjudication date came backwards 2weeks!! The biggest jump I've ever had. Very cool...

Once again....I hate to be the bearer of bad news. The REASON we all see our estimated adjudication dates have come closer by almost 2 weeks is due to TWO petitions being approved in 18-20 days.

Carly and Evan Canada NOA1 10/1 NOA2 10/22

Misa and Kat Cuba NOA1 10/2 NOA2 10/18

these FAST approvals have messed up those dates until more realistic dates are entered into the timelines. This is why we've seen such a change. Just wait...they will move back again as soon as other wait times are entered.

I thought only Cuba gets approved very fast.....what about Canada? I think some officer f'd there.....

Something happened. They left us comments that they did not expedite and have NO CLUE why they were approved. Im glad they did...but have to wonder HOW that one or the September ones happened. Im pretty sure my request to expedite will be denied. Its rare they approve those.

Good luck Byron and Mirla

Come on now ... aren't you one of those positive people? I think you have a pretty good chance of getting the expedite, anyway I'm rooting for you

LOL...yeah...normally I am..I have my days...I think we've ALL seen what can happen when I meltdown. But thank you for your well wishes.

OK Operation Chocolate press release 2.0 :

Date FOR IMMEDIATE RELEASE

CITIZENS JOIN IN CHOCOLATE GIFTS TO USCIS IN HOPE TO GET SERVICE FOREIGN WORKERS GOT WITH FLOWERS TO DIRECTOR OF USCIS

- A Web based group of US Citizens frustrated with waiting times that have increased from one month to five months and growing for the first step on the long process to bring their fiancee's to the USA has sent loads of Hershey's Kisses to remind USCIS that they are waiting to be with their loved ones -

This week dozens of pounds of chocolate kisses were sent to the USCIS Vermont office by US Citizens applying for I129f visas for their fiancee's to join them in the USA. The first step in the year or longer process that continues once they arrive in the US is the I129f petition to show the fiancee' is initially eligible to apply. These citizens are also frustrated that foreign workers holding H1B visas can get a visa for their spouses in just one day from the US Embassy in their home country.

Waiting times for this initial step have increased from one month in April to five months and climbing. This is in spite of a more than 150%increase in the filing fee in July. This extended time apart is very stressful for the couples who have to deal with separation anxiety, medical issues like miscarriages or family health emergencies, even children being raised without one parent.

These citizens are frustrated that USCIS is giving priority to work related visas and has pulled immigration officers off their cases for other priorities. This type of I129 petition is also not allowed to pay for premium 15 day processing as employment visas are allowed to request. The citizens hope that by sending these chocolates they can get the same positive response foreign workers with H1Bs got by sending flowers to the USCIS director earlier this year when they sought, successfully, to extend an already unusual opening for them to file greencard requests.

Hi virgillionare,

Looking great. At the end of this, "Hershey's Kisses to remind USCIS that they are waiting to be with their loved ones -" Please add this, "in which they are trying to follow the legal way of bringing them to the United States."

And after this, "These citizens are frustrated that USCIS is giving priority to work related visas and has pulled immigration officers off their cases for other priorities." please add this, "while adjusting the US citizen petitions for their foreign spouses and fiance(e)s visa processing times to what many claim an unreasonable, unfair, and immoral internal goal of 6 months for doing just the first portion of the long process."

How much does it cost to pay for it to ensure it gets in? I think I saw where we could pay or where we could email it and hope it gets in. Is this correct? Please clarify. Again, thanks for all your efforts on this.

Same old bullshit I see...zero!!! Day in and day out...and a few folks don't think there will be people hitting 6 months and more...we'll see...

Good luck all May and earlier filers...weekends suck so bad especially as each week goes by. Come to think of it, week days don't give me much encouragement either since they only approve about 2 or 3 VSC VJers a week and some of those are unexplainable.

Hey Bill B,

thanks for the comments and the additions. I put the first one in but the second one didn't read right can you double check it for me so it says what you mean. I'll add something in that vein at least.

As for the press release distribution. It's free to send one to AP, they have an email address for it. Other places like CNN we'd have to email and hope. One news group said they wanted press releases only from one of the press release services like PRNewswire.com, Business Wire, PrimeZone or Market Wire. Upon checking these places I saw prices like $350 to distribute to all the news services.

I did see one site when when I searched "press release how to" that offered to distribute for $30 but it read like it only distributed on the web or 'in search engines'. Sounded like you get what you pay for to me.

We also have the Post article and she'll put it in if we do it soon enough. Then the story can get 'picked up' as they say. So I'd like to do this soon ... What do you think?
