Seriously, I don't give a cucumber about my adjudication date...!

A cucumber!!

   CUCUMBER    In Spanish it is a very common saying (i have heard my family use it often). I dont give a cumbumer! When you translate it to English it sounds hysterical!!! THANKS MIRLA!!! you made me laugh and I hope you are correct... my touch was not due to a call.

I finally got to speak to the mayor's office. They said their wasn't much they could do since they do not deal with immigration. They are fowarding my information to the Senator's office because they can write a letter on my behalf. blah, blah, blah.... Disappointed, but still surprised they got back to me. :o

Steph1973,

Thanks for the update. Glad to see you are not just sitting down and waiting on the system to help you. You are out there trying to help improve the situation. Everybody needs to because at this rate of approvals it will take more than 6 months for some folks to get their NOA2. We want to do all we can now and not try to help ourselves when it is too late and we see a date beyond 6 months posted on the VSC processing times chart (as is now with the CSC chart)

Good luck all. As US Wendy said in one post, get angry...this will help drive you to take action that may just help you and those after you. For those of you who filed in June and later, if you don't take action and see yourself waiting more than 6 months, don't say I didn't warn you and try to help you negate your plight. The system needs fixed and families need to come before employment VISAs, period. Premium processing needs to be offered to K1/K3 VISA petioners, period. The more that fight for these changes, the better the chances for success. Good luck all and may you get to spend as much time on this earth together with your loved one as possible.

This may be a stupid question, but who has the right to change the law so these visas are prioritized correctly? Who should we be targeting our efforts towards?

From everything I read, USCIS sets their USCIS service level commitments also known as service level goals for each type of application/case. As far as I know, only the I-485 has a specific timeframe based in law as they allow processing of an application for an Employment Authorization Document (EAD) within 90 days of filing as mandated by law [8 CFR 247a.13(d)]. If anybody else knows of any others, speak up please.

Yes, its the "law" set for I-485's that I am interested in understanding. If I want to argue that this law is unfair when compared to the lack of law around the K1/K3, I want to speak to the right people. Congress?

In addition to your congressmen and senators, you should write Congressman Thompson since he oversees the entire DHS, which USCIS falls under:

Hi people,

I know I'm a little more negative than most people here. So, I stay positive on the board, but must put my negativity to constructive use. I am prepared to "hold out" for the 6 month deadline on Nov. 18th.

I pray everyday that Mirla gets hers soon, but the way I see it, if Nov. 1st comes, and she still doesn't have it, she's a martyr for our "missed app" cause. And we will have to prepare her in everyway possible to fight USCIS and VSC for her Nov. 9th deadline. We have to make sure that we have this congressional-help process in place so that we can start fighting our 6-mo. and over statuses right away.

So, if we have a well thought out plan that she can follow. Then we can watch how they begin to respond...... then we can all follow it one-by-one as our 6 month deadline passes, and they will be so overloaded with Senators/Reps/phone calls from all of us (letters and who knows what else)... that they'll have to do something.

Until then, I am going to expect the "well.. you have to wait 6 months" bullshit. But let's be prepared for when their excuse expires!!!!

*having a really overloaded day back at work and pissed off like hell!* B)

Mirla,

I'd have Pat contact the Congressmen now...fax them the authorization NOW to gain information from the Department of Homeland Security and USCIS. I'd also write a detailed letter of the progress, time line, phone calls and let them know in advance that you WILL be contacting them at the 6 month mark. I'd get a name of a case worker in the congressmans office and "make yourself known" NOW...before the 6 month mark. These congressman are staffed to handle this...however they also are busy...I'd get the ball rolling to "prepare" them that this is coming in the next 2-3 weeks. They may not actually do an inquiry till after the 6 month time has passed, but I'd not wait till the time is here...I'd start at least 2-3 weeks before.

I already have my authorization in at my congressmans office..have my contact in place...built the rapport with them...and have the next steps in line. And im not at the 6 month mark...mine is more for my consulates office in Cairo because they are soo slow.

I hope this helps...

Thanks for your help Amrssnowangel, I was thinking about getting in touch with our lawyer first.....I don'''t know what he will say but I'll let you guys know tomorrow...

Just FYI all, Have you noticed the words on USCIS's document "Case Services...How Do I...Know What USCIS Services Are Available to Me After I File My Application or Petition?" found here:

http://www.uscis.gov/files/article/f_english.pdf

If your case is outside our current processing time The processing times that we publish let you estimate how long it will take us to process cases filed before yours, and then process your case. However, every case is different and sometimes an individual case can take longer than average. If you don’t hear from us within the normal processing time, check for updated processing times on our website. If your case has a receipt number, use it to check on the status of your case at the same time. We recommend this action on your part because our notice may be on its way to you.

If at any point your case should become more than 30 days outside our normal processing time, and you haven’t received a written decision or update from us within the last 60 days, you can help us

by calling customer service and letting us know. We will research your case, see what needs to be done to get it processed, and get back to you with an explanation. • The extra 30 days is to allow time for any notice from us to reach you as we process your case.

In other words, don't bother calling us or taking action until your case goes past the 7-month point, assuming they are calling 6 months the "normal processing time." I wonder, was it considered the "normal processing time" in March and April when they were turning them out in less than 30 days?

I'm glad to see a lot of you are like me and not waiting that long to contact someone. The way I see it, if we wait until say 6 1/2 months and then call them they will most likely say "wait another 15 days" and call us back. Sorry to share this terrible time in the history of USCIS with all of you...for other May filers: wish we would have filed just a little earlier. Many of those folks are already set for their interviews.

Good luck everyone. Looks like we need an act of God or at least Congress to help us. Unfortunately with everything we have going on in the US and world now, our issues with USCIS are considered very low on their agendas. The only hope is strength in numbers...

I personally find this to be distatesful and a bunch of BS, and have thought so ever since I read it on their website a month ago. I can tell you without a doubt that when my case hits the 4.5 month mark, my congressmen and sentators will start getting a letter every hour 18 hours a day. At the 5 month mark, the letters will continue and the phone calls to the "Customer Nonservice" line will begin, and they will get calls every single day, probably multiple times per day. EVERYONE will know I am PO'd! Because, and this is purely selfish here, but I am already upset that they cant clear out everyone ahead of me so that they can get to my case. By the time the next 4 months is finished I will be livid. I have zero patients for stupidity, especially government stupidity because they know that they dont service anyone in any government oranization very well, yet they do nothing to fix the systemic problems. I gotta stop now, because I am making myself mad just writing about this!

I tried to get my US Rep to speed the process back in July (which is probably why USCIS dumped my file in the trash.. jk), but I had a Rep's person contact them to inquire. I actually found the second guy to be more useful, so I am going to follow-up with him.

I think we should also look at Senators. I'm in Pennsylvania and will have to start looking into this.

Have Pat do the same.

I spoke with my Senator's office a few weeks ago. The aid told me that by federal law all they are allowed to do is inquire as to what the hold up is with the petition. Per the aid, they can not expedite anyone's approval.

Don't know if he was giving me BS or what. I faxed a form to their office that gave them consent to check on my case if I have not been approved by six months. If I am not approved by then, I will be calling the Senator's office everyday until something is done. Until then I will have to wait.

I am still hoping May filers will get approved this week. I need to stay positive or I will go insane. Uh-oh, too late.

If you need help with PA senators let me know. Our family personally knows Senator Punt. His daughter went to school with my son. He's done work for me before in the past when I lived In Waynesboro. He is a good man and Im sure his offices will help. Good Luck

Im pretty sure your fiing date is the week they are working on. Yes, I was told also that My Senator or Congressman can't hasten the process for us, but can only "inquire". However I do believe that once an official "Inquires" it does help....they recognize that some one from the senate or congress is "watching" and if to many are inquiring maybe USCIS will take more notice to those petitions out of timeframes. We can only hope. HOWEVER Im getting the letter from them each to send to my Embassy as well. Cairo is one of the slowest ones out there...I want them to know in Cairo that this case has the "interest" of my government officials and that they expect to know when the case is completed and approved. My congressman and Senators all have agreed to do this. Sort of a power play maybe...but im NOT wanting to wait another 10 months after our interview like some from Middle East have that Ive seen on here.

Either way...I think its a good time to "get to know" your case worker and network yourself. The nicer we are to those people that will inquire for us..the more they feel they have a "personal" interest in you.
