Of course!

The K1 is for someone to enter the USA and get married within 90 days. If there is no wedding, they must leave within the 90 days. And you shouldn't even enter the country using the K1 if you already know there will be no wedding.

Just to add my experience.

I took a quick trip from England to South Jersey for a long-weekend last week to see my fiancé. Currently awaiting NOA2 from TSC. The only issue arriving at PHL was the insanely long line to get to the immigration desk. Other than that entry on an ESTA was exactly the same as before. No problems at all.

I just entered the US at the border in Calgary - I was flying from Fort McMurray to Portland, Maine and seems like the last city in Canada is where you pass customs etc. I am staying until Dec 15th - my original plan was to return to the UK from Canada, but decided to spend some time in the US before returning to finish up the UK part of the K1.

I walked up to the women (who was actually quite rude and mean) and told her that I was visiting to stay with my fiancé until Dec 15th. I have a B2 and visited from October to March, spend March in Costa Rica, returned to the US for a few days, then went to the UK for 3 weeks to finish up my PhD, then have spent the last 4 months in Canada. She really did not like that I had not been in the UK for any serious length of time since October last year. Still, I have been out of the US for a good length of time and specifically visited Costa Rica and worked in Canada to spend time out of the US.

She asked me lots of questions, then took me into the back room, where she left me sitting for 20 mins or so. I was then called up to a window with someone else, who asked me further questions. I showed him a scan of the NOA-2 and explained that we had been working in Canada and had changed our plans because of delays at Texas. I told them from the beginning that I had a K1 visa application, and was going to return to the UK to finish this up so I could immigrate the correct way. In the end everything was fine but it was very nerve-wracking and until the very second he gave me my passport back I was unsure whether they were going to send me home.

So it worked out fine, but they definitely had issues with the length of time I had spent in the US and out of the UK

So this one is sort of backwards but I've heard of people having problems coming to the UK with a K1 open so:

Tina (who is the American citizen of our pair) just came over to visit me here in the UK. I had read a few horror stories so she had a bunch of things with her: employer letter, official letters to her house, lease agreement, an amount of money in sterling that seemed enough but not too much for the trip, etc etc. Anyway as it turned out she was asked a few questions about her trip and our relationship and future plans, but the UKBA person seemed to relax when she heard about the K1 and our plans for me to move to the USA. I guess that made it less likely to her that Tina would just jump ship, so to speak, and never catch her return flight.

So no problems, basically, though it doesn't hurt to be prepared. We'll see what happens when I visit her in October....

June 11th 2015 - NOA1. off to California Service Center :D

July 27th - NOA2 !!! much faster than expected

August 19th - rang NVC, got LND case number and told our file is 'about to go to London'

August 20th - booked medical at Knightsbridge for September 16th, 10:10am. Feels good.

September 1st - rearranged medical for October 5th, 13:30, because reasons.

September 4th - packet 3 received.

October 5th - medical completed at Knightsbridge. X-ray technician suggested playing Barry White during the procedure.

November 12th - visa interview. Nailed it!

November 20th - collected visa package from DX Southampton

December 6th - one way flight to Philadelphia!

December 31st - getting married! :wow:

NOA1 to Interview: 5 months and 1 day.

Hey guys, I have one question which I didn't find a definite answer for.

I received the NOA1 and I'm waiting for the NOA2 at the moment. I have a trip to the USA planned for december 21st, which was the goal date for me to have the visa and to go for good to America. However, even with the fast processing of the K1 visa lately, I probably won't be able to go and start the process by that time because of some problems of my university in Brazil. Instead, I will have to go on February/March.

Is it possible to travel to the USA with the K1 visa issued and a tourist visa, but choose to use the B1 visa instead?? I heard from another brazilian here in the forum that once he was able to choose between his J1 (study) visa and tourist visa, but I never heard about the K1..

I know that the process is not the same for everyone and it might take longer than this hypothesis, I am just thinking in all possibilities considering that I already have that plane ticket and it would be the best to go earlier :)

Nope, cant do that -

I believe you´d have to postpone getting your K1 visa until after you return from the US.

Enter in DEC on tourist visa as planned, return, got to K1 Interview, get K1, return to US within the validity of the visa.

I hope someone you has done it will have an opinion as well, but I believe that was what people discussed last time this question came up.

Have you tried the VJ search function? Whenever I try the newest entries are on the last page, maybe give that a try?

Hi Everyone, I'm very happy to have found this thread/forum. I am a Canadian engaged to an USC. He was originally living here in Canada with me, however found a great opportunity in the U.S. I am 4.5 mths pregnant and when we were initially trying to determine the best route for me to accompany him to the states we thought of the K1 however didn't like the idea of having to marry within 90 days as we wanted more planning time and to have the baby first. I am a professional Geoscientist and therefore qualify for the TN visa with a job offer. We called the USCIS and enquired of the best route to which we were consulted to have me enter as a visitor where o would be allowed to stay 6 mths and this would give me time to figure out a visa option and a chance to apply for work. Well long story short I was denied entry as the CBP were concerned o did not have strong ties to Canada as I was unemployed and did not lease a property. We are meant to be catching a flight to London from the US for a wedding. I will need to fly to the US to catch the flight but am concerned I will be denied again as I am staying with my mother while I wait for the K1 to process(forgot to memtion we ended up going this route after denial) so will not have lease and I do not plan on starting a career as I am about to have a baby. I called CBD here in Edmonton and they said a letter from doctor stating I need to makeon they visits for the duration of my pregnancy as a suitable replacement to proof of employment, but I am still

a little concerned as it is all so subjective and basically down to the officer I encounter at the time. Does anyone have any advice on additional information or similar experience or success story on gaining entry after being denied??

Hi all - as well as hoping someone can help the poster above, I wondered if anyone might be able to give me any words of wisdom.

As there is still no interview date assigned for me, we're going rot have to move our original wedding date by the end of the week. The problem is, I have a group of friends who have booked flights and made plans to be over there for the wedding.

With my visa processing at the embassy stage and my visa waiver having ran out in August, would there be a potential problem if I were to reapply for it in order to fly out to have some sort of celebration with my friends who are unlikely to be able to reschedule their flights and plans, if I still have no interview date/interview date is scheduled for past the original wedding date?

In other words, would I now be in all the systems as having applied for the K1 visa, making it suspicious that I was applying for an ESTA WVP?

I don't need any of the 'you were told not to make plans' stuff, I know that, and I would've rather not done anything until I had the visa in my hand, but it is what it is.

I renewed my esta during my k1 wait (I had to, because I applied for a new UK passport so it wouldn't expire for ages once i was in the USA - new passport means you need a new esta). I had no problems. I don't think esta is linked up with the k1 in their system

Hi everybody

Great tread!

I am about to visit my fiancé for aprox 3 months (hopefully for the last time before our K1 gets issued). Only problem is, that since November last year (2014) I have visited the States 3 times total for extended periods at a time:

5th November 2014 - 30th January 2015

3th April- 17th June 2015

21th July - 28th July 2015

My intention is to enter the States on the 20th of October 2015 and go back on the 16th of January 2016 but I am nervous that they will have issues letting me into the country since I have been in the States collectively almost 6 months and due to my long stay this time around too

On top of that I am self-employed and live with my parents to be able to afford visiting my fiancé and having my company so I don't have much proof of wanting to come back to Denmark where I live.

Does any of you have a similar story to mine and do you have any advice to give?

My fiancé says I worry to much but I just feel there is so much t0o loose if they won't let me in.

Im so tired of worrying about this.

Fortunately we just received the NOA1 and everything seems to be rather fast these days. Can't wait until this is over and we can just start our lives together.

Once you receive the K1 the tourist visa is automatically cancelled so you won't be able to use it. You can prolong the K1 process if you need more time.
