I am trying to figure out what could be determining factors in skipping the AOS interview for K1 visa holders.

 

I was hoping people who received their green card without an AOS interview could share their experiences:

-How much time passed between K1 interview and AOS application?

-How long were typical wait times from NOA1 to receiving green card from your local office?

-What was your case status on the USCIS website while you waited? (Mine has been for almost two months the same: " we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status Our National Benefits Center location is working on your case.")

-Did you at any point know you would be skipping the interview?

-How long did it take between NOA1 and green card approval?

 

Any other information that would be relevant would also be appreciated!

No interview. As you can see from our timeline, our wait was significantly long. Had our case been actually routed to our local field office, the wait would have been even longer. Note I said had. We had assumed our case was stuck at our field office, the reality is our case had been shipped elsewhere to a field office in another state. We had no status changes or updates until we received a medical RFE - after responding, our case was approved soon after. We assumed the interview would be skipped once we were aware that the case had been shipped across country (there was no indication up until that RFE)...

Interviewed August 11th 2016, Arrived in US October 19th, Applied AOS November 17th 2016 - roughly 3 months

 

-How long were typical wait times from NOA1 to receiving green card from your local office?

Roughly 10 months. This is what I attribute a large degree to when it comes to interview waiver/direct approval at the NBC since USCIS practices workload distribution between its offices.

 

-What was your case status on the USCIS website while you waited?

Name Updated, since I sent a SR for a typographical error but prior to this Fingerprint fee Received. Once you get the update "Ready to be scheduled for interview" , the jurisdiction is at your local CIS office. From here you can either get an interview or a interview waiver letter.

 

-Did you at any point know you would be skipping the interview?

No, since there is no update while at the NBC

 

-How long did it take between NOA1 and green card approval?

100 days

I got a direct approval at the NBC, my status prior to approval was "name updated" and before that "fingerprint fee received", so no it was never transferred. We've had quite a few of these in the November filers - I was the first of the posters to receive it 1 month ago and then a number of additional ppl have gotten it aswell. Within that time several ppl have also had their interviews at their local offices - the ones with short processing times. Getting an interview waiver from the local offices can many times take longer than getting an interview itself.

No interview also for US.

 

You can review my timeline. No indication there would or would not be an interview. Did have an RFE for not having a signature on one of the docs but it did not slow anything. Took about 80 days. Received GC prior to any notice of approval. In fact, besides the NOA1, RFE, and a few updates online regarding biometrics scheduling and such it was pretty quiet until the EAD/AP card arrived. Ironically, the GC arrived just a week later.

 

It is going to be hard trying to figure out the determining factor for interviews. I admire you efforts but there are way too many variables that can take place and too much information needed inside immigration, which we do not have privy of knowing, to come up with a good factor.

-How much time passed between K1 interview and AOS application?

Interviewed 10/13/15, arrived 10/24/15. Didn't apply for AOS until 4/16/16. So just about 6 months.

 

-How long were typical wait times from NOA1 to receiving green card from your local office?

I don't remember what our local office was reporting at the time. A year or more I believe. We wound up at not our local office (which was my first clue that we wouldn't have an interview), but which oddly enough had a longer wait time. Couldn't figure that one out.

 

-What was your case status on the USCIS website while you waited?

We were part of a weird glitch where the website didn't recognize our numbers. At some point, my husband got them to fix it, but it remained "fingerprint received" the whole time, which I'm guessing is part of the glitch.

 

-Did you at any point know you would be skipping the interview?

We got the stupid medical RFE (the one where they ask you for your vaccination records even though they're the ones who have them), it came from the Newark Field Office, which is not our local office. I figured that meant we wouldn't be interviewing.

 

-How long did it take between NOA1 and green card approval?

192days (104 to EAD/AP)

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

It seems hit or miss but...

 

-How much time passed between K1 interview and AOS application?

K-1 Interview was Sept 22nd, recieved a 221g for more documents (a second cosposnor),
he was approved Nov 9th, six days after they received the documents,
he came into the country Dec 6th,
 we married Feb 20th,

his I-94 expired on March 4th,
we sent out the AOS application on April 7th.

197 DAYS FROM INTERVIEW TO AOS APPLICATION
149 days from visa approval to AOS application


 

-How long were typical wait times from NOA1 to receiving green card from your local office?

San Antonio had an almost two year wait time while we were waiting for the GC. CURRENTLY it is doing I-485's from may 2016, so it's at about a year average now.

 

-What was your case status on the USCIS website while you waited? (Mine has been for almost two months the same: " we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status Our National Benefits Center location is working on your case.")

The fingerprint status. It didn't change from that until he received the your new card is in the mail status. There were no RFE's.

 

-Did you at any point know you would be skipping the interview?

When the status changed to saying a new card was being produced. His EAD/AP hadn't even been approved yet, the I-485 just changed saying it was being produced and then later changed to it being mailed out.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
