Hello,

My partner and I are planning to begin the K-1 Visa process within the next month when he is visiting for the holidays. He is originally from Brazil and will be moving to the USA to be with me. At the moment he is currently involved in an internship, which will be ending in about a month as well. At the end of his internship he will find out if he will be hired or not. If he is hired, he will need to come to the USA to get 3 months of training in the spring.

My question is, if we begin the process for the K-1 visa the end of December or the beginning of January and he would find out he got the job and needed the training. Would he be allowed come here for that? He would be in California and I would be in PA so we technically wouldn't be together.

Does anyone have any information on how this would work?

Also if anyone knows how this would affect a CR-1 visa that would be great too. Just so we can go through our options.

So his potential employer knows he will be coming to the US on a K1 and there will be a gap when he is not allowed to work?

His employer has multiple US base offices so we are hoping he can transfer here once cleared with the work permit or visa. But yes there will be a gap within working.

We just need to know if he will be able to come to the US with his visitor visa for work, not to be with me, while his K-1 is pending. He will go back to brazil before the K-1 would be approved.

The training for his job would take place in California for about 3 weeks in March and then he would return to Brazil to continue working until his K-1 Visa was approved for him to come here for good in September / October

Just seemed odd that he would be coming here for 3 months and them immigrating with another 3 months or so not being able to work and what employer would do that?

Sorry for the mis-understanding. I just confirmed with him. He would start the job in Mid-Late January if he receives this position. And would go to california right away for 2.5 month training. Hopefully that clears it up some

Seems odd but can not see it being an issue.
