Why is there no prosecution for the crimes?

1. You're saying if an officer walks up and starts asking you questions, and you have the right to walk away from him and he doesn't have the right to keep approaching you, asking questions, or harassing you?

2. I really truly don't believe this happens. If anything it would inflame the situation and the individual would surely be arrested or brought in on some charge... albeit dropped later with no answer as to why you were brought in the first place. The BCPD was notorious for this.

1. They can be as persistent as they want, but (pending one more lousy Supreme Court decision), unless we cave to their pressure, they're bound by more case law than we are, and they know it. While leaving the scene, I would first ignore him, then (if necessary) say "I never discuss personal matters with strangers, sir. Good day." Almost any excuse will work.

2. Look at your state's Constitution or penal code for the language about official oppression. If the cop persists in asking what I was up to, and the above don't make him give up, I might say, "Contemplating Section 39.03 of the Texas Penal Code, sir. If you have not lawfully detained me by now, I must surely be free to go. Good day." They're looking for roll-over wimps and will typically be startled by someone who won't cave to their games.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As we all know, there are recent instances of black people being injured or killed by police. In almost every instance, I've sided with the police because of the difficulty of their job and their need to protect themselves first. Those who share my viewpoint always use the same argument to justify the actions of the police. "If the person would just comply with the officer's orders, this wouldn't happen."

Knowing how things are now, I find it impossible to suggest to people that they should just walk away and ignore a police officer. That is definitely not compliance.

thank you, bj. i was worried there for a minute i was the only one who noticed this disparity in perception.

i'm white and i'd never, ever have to cojones to walk away from a cop addressing me directly. not smart at all.

As much as I'd like it if things worked that way.. they simply don't in the real world. You walk away or refuse an officer, or get even remotely mouthy by quoting some 'law', you're going to be brought in or worse. And there is enough evidence for that fact.

Yeah, I believe it's called refusing to obey an officer of the law.

However lurking thru this thread I am glad to see we have gone from prosecuting Hillary to cops killing people in under 4 pages. Maybe the chest I loved is making a comeback.

After posting what I posted but before seeing the above arguments, I referred a (non-VJ) buddy to look at the conversation, and these are some of his comments:

I can't accept the notion that a police state is the price that we must pay to live in a free country.

It's foolish to whine to politicians while allowing the police to bluff and bully us. "Your papers, Comrade!"

We've grown afraid of government down to even the local level. Law-abiding people are afraid of their police. That is sick.

We are the law! We merely delegate it to the police & courts on condition of good stewardship. Remember, the purpose of law is to facilitate a reasonable society. The law is a means, not an end. The law is to serve us -- we are not to serve the law.

Honest citizens who are not ignorant of their rights or police procedure can deny the infant police state the one thing it still needs to operate: cooperation. Barring actual probable cause to arrest, the average soul has little to fear from cops who overstep constitutional bounds. If you don't stop potential excesses at the earliest possible stage, all they can do is snowball.

His e-mail to me was stamped 7:27p Friday, so he might or might not have read the more recent posts above.

I still believe that cops are bound by more case law than we are. They know that, but they don't know that we know that. Therefore, they might be set back on their heels when we (very politely, yet firmly) exercise our knowledge of our rights and use this to depart the scene before the cop can escalate it.
