Hi people,

I am very new in this forum, but terribly need advise from you guys visa journey gurus out there.

I came to the US to join my lovely wife who happen to be a US Citizen. We married in 2013 in very honest good faith in the name of starting family together upon my arrival here, abroad she came back to process my visa, I came into US roughly mid march last year under a 2 years probation GC, sadly my wife has been living a double life, I noticed something wasn't right in earlier last year when I got here.

I suspected she was seeing an American boyfriend, one day GOD brought things from the dark to my attention, the boy friend came and left a note saying "i should not ask her where she has been"

I asked her why did she married me and make me come here if there was someone she was interested, that was just the beginning of the drama, she started going out wildly of which at first she told me, then changed into not telling me, spent 24hours without coming home, she talked to me angrily with attitude, one day the boy friend texted asking me ''are you happy?" I had access to my wife's cell phone, so I came across text mgs of him telling her he feels used and will repay.

But according to what my wife told me about this dude was he wasn't a good man and is capable of doing anything bad either to me or her.

I never mate this dude before only one day when I was at work he texts cursing me and threatening me, I got home from work and found the dude in the apartment with my wife in the sitting room on separate seats.

I had to leave the house in fear for my life, we are are separated currently. I went a very hard time during winter since it has been my first winter experience, I had to move in to our wedding matron to survive or else I wouldn't have no where to go.

I have 6 months remaining to remove condition but I wish not to ask for her help for I don't wanna pretend like we are still living together because She has caused me enough pain. I wanted to go back to my country and start a fresh, but she suggested I stay, because she refused to devorce me saying she is still looking if things work, but has been living with her boy friend ever since, she even hid my green card but gave it back to me after realizing how hard my life would be without it.

And last but not least, my income is so small that I cant PAY an immigration lawyer to help me on what to do, if I go back home it is going to be extremely hard for me because I lost my beautiful job just to join her here.

PLEASE ADVISE

you have to get divorced, ROC on your own and show you entered the relationship in good faith. you dont need a lawyer but you need to spend time on the papers yourself.

You do not need your spouse's approval/consent to divorce in the US. File for divorce, compile your evidence, submit a divorce waiver with your I-751 to remove the conditions on your conditional (NOT PROBATIONARY) green card, and get your fresh start right here in the US. No lawyer needed. Your case is not complicated. Good luck! :)

Thank you very much for your quick reply, but how long does devorce take? Remember I am only left with 6 moons before my 2 years anniversary which happens to be my GC expiration date.

You just need proof you entered relationship in good faith. i think a divorce is pretty quick but yes, it is a few hundred to file. you need to ROC before it expires. so make sure you file for the divorce ASAP and then file for the ROC saying you entered in good faith and show the proof. google here and see what other people did.

I appreciate your advise. You do not need the divorce to be finalized for you to file with a divorce waiver. 90 days before the expiration of your GC, send your application, even if you do not have the divorce decree. Later on, USCIS will send you an RFE for the decree and you will have time to respond and produce it. In the mean time, file for divorce so you will be more likely to have the final decree before you apply for the ROC. Good luck!

Sorry to hear that you had to go through such ill treatment here from your spouse. it can be hard to leave your own country and come here trusting someone and get such harsh betrayal. Like others said if you present good evidence of your marriage like joint finances ,lease, insurance photos with family , sworn letters by people who knew you both etc you can file the divorce waiver now and start your divorce process asap and like Cheezees said you will be asked for divorce decree later in REF. good luck to you and hope it all works out !

Thank you friends for all your good infomation about my case, but I became hesitant about filling for a divorce for 2 reasons

(1). Some people told me to do away with divorce filling because women in American have all the rights and are more listened than men, and that she may turn the story around despite all she put me through. She can make it even harder for me if she says I am the one who left her.

(2). I was seeking divorce lawyers but prices got me think again, I came across one lawyer who wants $250 per hour.

Any advise on cheap and best devorce filling law farms around Columbus Ohio?
