K1 petition from X denied- new petition file of new petitioner (merged)

Hi everyone,

My name is Keizy and I met my Fiancee last November online, we got engaged last March and we will apply for Fiancee visa by August using rapid visa. My question is does my previous fiancee visa which is already denied by USCIS could affect my current application? Let me tell you something about my first application.

That was filed by my ex fiancee which is already with somebody else now. Please advice me.. Reason of denial was he submitted a divorce decree that was not issued on his local municipality. This copy was the one they signed in front of the judge, after the denial we filed for appeal of case. But it takes forever until he wanted to go back to US which I could'nt go yet.. So he hired an attorney to work for it, he advised us to cancel the appeal, write a letter to USCIS that we want to cancel and refile. And he wrote that letter. Three months case has finally cancelled, but i found out he was cheating on me, and I decided to leave him.

You will definitely be asked about it. How much of a problem it is depends on the timeline;

how long ago was the first K1, and how long ago did you split with that guy? How many times have you met the new guy?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What Penguin was asking was how long ago did your ex fiancé cancel the first petition? How long ago did you break up with your first fiancé? How long have you been with your current fiancé and how much face to face time have you and your current fiancé had together? Because the answer to those questions will determine if that first petition will cause you any problems. Having a previous petition doesn't mean a second petition will be difficult. But if the filing of the two are close in time, you'll have more questions asked of you. The closer the two petitions were filed the more evidence of a genuine relationship you'll need to include.

The first petition was filed sept 2012, they request for more evidence on april 2013 and denied it by may 2013.

We filed I-290b notice of appeal on May 2013, but status still under review for 1year and 3months. He write a letter to of cancellation Sept 2014, and finally got cancelled February 2015. We stopped talking around november of 2014.

I met my fiancee last year November 2015, met twice, we travelled to taiwan and hongkong. We spend 25days in total together. Its like more than a year when i get to a new relationship.

You could save some money and use the guides on VJ instead of using a visa company, they don't speed anything up!

10/28/2015- NOA2 (237 day wait at TSC)
11/13/2015- Sent to NVC
11/27/2015- Arrived at Embassy
06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

when is the counting started? is it during the appeal of case which is may 2013?

The time starts counting when you broke up and met the new guy.

You don't want to look like you are desperate to come to the US because the first try didn't work out.

It could look like you lost your patience and left the ex.

I would add a timeline letter of your new relationship, how you met, how your relationship evolved into love

and the visits and how you both grew as a couple etc....then also mention that your previous relationship didn't work out because

your ex was not faithful and that is the reason you left him.

Submit it to USCIS with the rest of a quality package that you should front load. Google the threads on front loading

to find out why. Forget Rapid Visa, save the money

and follow the steps outlined in this forum. You will get much more detailed advice then that visa agency would give you.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Yes, YOU should provide as much documentation and evidence that the last relationship didn't work out (any emails or texts you have might be helpful, but just providing a letter explaining what happened will be helpful too) and then provide a lot of documentation and evidence that this current relationship is real and you truly love each other. And I agree with everyone else - don't bother with Rapid Visa!

I don't have anymore conversation its all gone.. Right now he's with the same girl. what would I do then, the case was already cancelled and he cancelled the petition, he cheated so its not my fault.. I don't know what else to think. But i will go to this process and if it didnt work out,we will find another way. Get married in my country. I hope they dont judge me from my past.. Its not my fault. :(

Hi everyone,

Anyone has the same case like mine? I had previous k1 petition but it was denied due to his divorced decree. My X filed an appeal but he cancelled the appeal so he can re-apply that makes the process faster. But while we was waiting for the case cancellation he changed a lot, he found someone another woman.

I met my fiancee after we broke up and we will have the petition apply next month, does old petition affect the new one? I know its from a different guy, definitely not my fault.

Anyone who has the same experience like mine?
