Waiting for AOS through marriage, and got a Job Offer.

Thank you for reading. I recently submitted my AOS based on marriage, and I submitted the form for employment authorization along I495 and I130.

I received a job offer last week, but I won't receive my EAD until the end of the summer or probably early September. They want me to sign the employment agreement and send it to them. I would start on September 1st. What should I do? Is it legal to sign it while waiting for AOS? It's not a contract per se, but an employment agreement.

Any chance of adding a stipulation to the agreement stating you will start on 9/1 if you have your work authorization then? Something along the lines of "______ will begin employment on September 1st or when s/he has his/her work authorization permit, whichever comes latter".

Sounds like a grey area to me, but I don't think it would get you in any trouble.

Also, you can use the job offer to ask for an expedite of your EAD!

If it isn't difficult, it isn't worth it.

Someone has mentioned that to me before, any idea of how to do so? Thanks for your reply!

My best guess at this point (since the application is in process) would be to schedule an infopass at your local field office and show them the job offer. Maybe they can expedite it from there. Good luck.

As A'n"L said, having a pending job offer you can expedite your EAD.

You should call USCIS call center and place a request to expedite.

They will ask you a reason - pick # 1 "Severe financial loss to company or ​person​". They will give you a # of your request (Referral ID). Write it down.

Within 5 days (or so) you should receive an email or regular mail:

"Type of service requested:

-- Expedite

The status of this service request is:

Upon receipt of your request for expeditious handling, your case was reviewed and a determination was made that we need additional information to make a decision regarding your request. Please fax proof of your financial loss, such as proof of a pending job offer, to the following number: 123-456-7890, Attn: XXXXXXXXXX. Please include this notice with your fax. Documents should be submitted with an official letterhead"

I faxed my pending job offer along with a Cover Letter, where I explained why it could be my financial loss.

It took 2 weeks to receive my EAD after placing the request to expedite.

You need just your NOA1 of your I-765. You will be asked for the case #, when you call to expedite the EAD.

If you didn't have your BIO yet, I believe you will be called for this before they issue your EAD.. Well, seems like with a request to expedite your Work Authorization you will probably"expedite" and your biometrics :)

There isn't an interview for your EAD.

This is not AOS from work. I got married to a us citizen and happen to have received a job offer.

The groups refer to under what status you last entered the US. Family-based visa would be K1/k2. You stated you were concurrently filing i130 with AOS, so you probably entered as a tourist or student (?). That's just how they group the posts on this forum:-)

If it isn't difficult, it isn't worth it.

What visa are you adjusting status from? If it is not from a family based K visa, then this is the correct forum for you.
