No indication what visa you seeked....tourist visa applications are not appealable

cImmigrant visas ban be, so iff you got a 221G saying YOU are approved to file waiver

do not attempt this kind of case on your own= a serious misrep you are being accused of

No one here can help you write any letter to fix this even some attys may not be well versed,

however you need an atty..the great Karl Shusterman (expensive) should be contacted, its

a doable case overtime & money depending on who is able to pin down the arguments you

are trying to make, so try to google or email him

Problem is she doesn't even know if she qualifies for a waiver. My understanding is it was a K-1 visa that was applied for and straight up denied because she was already marred. How she thought she could get a CENOMAR being married I don't know. So now he would have to refile and wait for the interview to find out if she has a life-time ban or not.

i'm applying for k-1 visa, unfortunately several weeks after my interview (Sept 2013) the embassy sent back my passport and a notice that my visa was denied due to the following grounds INA 221(g) you have prior, Unterminated marriage / 212(a)(a)(6)©(I) - you have sought to procure, or have procure, a visa or entry into the United Sates by fraud of by the willful misrepresentation of a material facts. Basically, i can apply for a waiver based on USCIS Form I-601 as indicated. Recently, my previous marriage was annulled and i have all the legal documents as proofs and evidences that will somehow negate the issues concerning unterminated marriage. Admittedly without further excuses i committed serous offences for being dishonest and deceitful . Hopefully with your advises i can able to work things out in favor of me. Thanks

Yes, that was 3 years ago ! I have to undergo Legal annulment procedure in order to terminate my previous marriage. Now since i'm single again i can marry my fiance anytime however, i have to seek K-1 visa approval first for that matter. thanks

Their response about fraud & misrep to get into the US are very serious & hard to overcome decisions,

Please be advise some of these decisions carries a lifetime ban, you need to be speaking to karl Shusterman

who handle waivers with uphill bumps and curves, he's the specialist on waivers.

Waiver can only be filed if a CO authorizes it

First step will be filing a new petition. You cannot use the previous K-1, since you were not qualified to submit it, being married at the time. You will need to file a new K-1 or a CR-1 petition if you have already married the petitioner. Once that is approved and you are at the visa interview stage, youo will be denied based on the misrepresentation ban; at that point, you can file a waiver request and see if it will be approved. Long journey ahead of you.

At this point in time, i have not marry my fiancee yet. recently i just got my annulment on my previous marriage, My last application was denied (3 years ago) with the following grounds such like prior unterminated marriage and misrepresentation. According from the notice from the CO i can apply for a waiver (Form I-601). I'm not aware about that i have to reapply for a new k-1 visa application and so on.. as you mentioned and If that will be the case oh my god, yes you are correct... sorry to me thanks a lot .....

I have a notice from the CO indicating my committed inadmissible grounds last 3 years ago.. How would i know that may case can still be reconsider ? I have read the waiver application instructions pertaining to K-1 visa and accordingly i can apply for a waiver. I hope my understanding is correct. Fraud / misrep are very serious offenses and the decisions may bears lifetime ban and i have no objections with that . Pls tell me what is the effect of my recent annulment in connection with my case.. Can it brings or carries significant impact that may allow reconsideration or perhaps merits approval.

Your prior K-1 is denied, dead, cannot be revived because you were not free to marry when it was filed.

Your partner can now file a new petition and when you are interviewed you will be told if you need to file a waiver or if you are eligible to file a waiver.

You start over from ground zero.

what if the beneficiary did not know that their partner was still married?? would they still get the ban and would that cause problems for them filing out the K1? I knew someone this happened to. she ended up divorcing him and moving on and not filing AOS but i wondered what would happen.. since she had no idea he was still married when they married:/

So you mean to say that i don't need to file for a waiver for now since my previous K-1 cannot be revived because it was denied and dead case. thanks for your valuable time and for sharing this information. I will discuss this matter with my fiancee thanks a lot #belinda63
