Hi All,

I need some information. I petitioned for my husband to come to.the States on a k1 visa. It was approved and we were married in.June 2014. I submitted the i485, work auth, and travel document forms 2 months later. He received everything by June 2015. In August he returned to his home country to visit his son. Less than a week after he returned I learned that he was having an affair with several women he had met on a dating site. I also learned that two months after submitting all the forms for his green card employee authorization document and travel Document he opened a new Facebook page under a different name that made no mention of me or our marriage 95% ask his friends on that page more women. He was actually dating several of them. After receiving the phone bill from his trip home I observed a telephone number appearing numerous times. When I dialed the number I learned that this woman was his girlfriend and had no idea that he had a wife. When I confronted him he did not deny it. He said that he was human and I asked him to leave my home and return keys to all of my possessions. Later I learned that there were 2418 text messages that he had sent to this woman he had told her he was going to marry her and planned to divorce me. I also received the pictures of him and this woman together as well as other pictures. Shortly after receiving this information I was contacted by another woman on Facebook who informed me that my husband had been trying to date her on a tinder dating website since the end of June which was about the time we would have celebrated our one-year wedding anniversary. We did not celebrate it. I also learned that my husband was also dating several women in his home country and had promised to come to the States get a good job and then bring them here to live with him and marry them. Although my husband worke, two jobs he never contributed any money to the home. I paid all the bills. Instead, he used my cars and hus money to bring his girlfiends on dates. We had nothing together we have nothing to show that we were a couple. He removed all traces of me from Facebook. And blocked me. I put together a binder of information containing all of his infidelities all 2418 text messages and any other information that I had obtained regarding his Affairs and his deceitfulness. I submitted all of that information to USCIS during an infopass appointment. In addition I have successfully divorced him. And requested that USCIS conduct a fraudulent marriage investigation. I've also supplied them with a copy of the final divorce decree and asked that I am released from the I 864 as this was a fraudulent marriage as he did not enter into.it in good faith. He had no intention of remaining married to me and no intention of building a legitimate future with me. We have no information to suggest that our marriage was bona fide and that we never had any combined assets or children.He never wanted to take pictures with me or anything like that and post to Facebook. As a result I will not be going to the removal of conditions interview.I am done with him. I am done with the marriage. I am of course devastated I thought my marriage would last forever because I loved him. My question is is there anything else that I should be doing? Has anyone gone through this process? Can anyone tell me what I should expect to happen next?

You cannot be released from the I-864. Too late for that. Move on.

Now you are divorced he can file to remove conditions by himself.

Unfortunately you're stuck with the I-864 even after divorce unless he voluntarily gives up his Green Card and returns home. Take this time to get your ducks in a row, get the papers sorted and move on with your life.

How was he able to go home that soon after filing for AOS? Did he get emergency AP?

It doesn't sound like he will be able to file for ROC since you said you guys have no proof of marriage. So he shouldn't be able to get away with his plans. I imagine he will be sent packing soon enough

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

The first immigration officer I spoke with told me that an immigration judge could revoke the i864 once a determination of fraud is made. They told me once I submitted the final divorce decree, they would immediately shut down his status and place him on removal proveedings. Will his EAD be shut down immediately and will they contact his employer or am I supposed to do it? I just want to be disconnected from him and let the government deal with him unless they need to interview me again. The first time they interviewed me was a month after I gave them all of the information in the binder. It was about a 45 minute phone interview.

I think you'll have a hard time proving fraud. It sounds to me that he entered into the marriage but just was a shitty person. Just divorce and move on, there's no point in harbouring resentment. You'll just make yourself more miserable!

Thank you for your reply. We have or had a marriage license but we had not co mingled assets. I own my home and was going to have him added to it and onto my other accounts until I found out what he was doing. I was so hurt. It was like the floodgates of his double life opened up. Every day I was learning more painful information. People were contacting me with messages and screen captures daily. Just last week another woman contacted me on Facebook but I think her goal was to simply let me know she was seeing him now. She will soon find out that she had not won a prize. But I won't be the one to tell her. I'll let her think she has until he shows her who he really is.

Without knowing exactly what was submitted or the details of my conversations with the immigration officers, on what do you base your thoughts? Have you encountered this experience personally or do you work with fraudulent marriage cases from the governmental perspective? And, as mentioned in my room initial post, I am divorced. As a Christian, I harbor no ill feelings, bitterness, or resentment. This post is about ensuring I have covered my bases as I move forward, which is what dome would consider prudent and proactive.

If he is deported then by definition that will end the I 864, but that is somewhat unlikely.

What Boiler said. We're not judging, and can't know for sure the outcome but proving fraud is going to be hard. What you've explained is that he's cheated on you, it doesn't mean he entered into the marriage fraudulently.
