i751 Rfe - No properties, no credit, no money

Hope you guys can help me.

I sent my i751 in august 2015 and last week got a RFE. I have already submitted so many proofs and they are requesting things that I dont have now. Me and my husband were in a car accident a month after we got married, and we lost the car that we had and stacked up a bunch of hospital bills. Because of that our credit got really bad and we were never approved for credit cards, buying a house, loans or anything like that.

We used his dads car for a while until last year when we were able to save some money and buy a car for us.

We didnt have money for anything so I also didnt have health insurance.

RFE states that the car insurance, car title and health insurance doesnt cover the full lenght of the marriage.... Well, I didnt have a car or any insurance till last year..

thay are also asking for credit cards and properties in both our names, which we dont have.. what should I do??

another issue is that we have been using my in laws house as mailing address for a while because we live in a apartment where they always loose our mail, so when we had something important we would always give their address as our mailing address.. how can I explain that half of our letters have a different mailing address from where we live?

Sorry you've had it tough. You cannot help the fact that your situation is not "perfect". You must reply to the RFE stating exactly what you have stated here - that because of the car accident, these are the results.

You will both probably be called for a Stokes Interview - but if your marriage is bonafide, you will be able to pass that. It might help if your Dad writes an affidavit explaining about lending you a car. Get your in-laws to write an affidavit as to why some of your mail goes to their house.

It's all you can do. Best of luck to you!

PS: Got copies of those hospital bills? Copies of the Accident report? Send those in to back up your story.

Hi Susie, Thank you for your help. Ill try to send more bank statements from our bank account, I only sent 4 per year, maybe they want to see more.

Ill send them the car accident report and the bills, but what I was worried about is that half of the bills have my house address and the other half my mailing address. =(

I was so unprepared for this I751, because my first green card process was so easy and went so well, I thought this one was going to be easier. If I knew that I would have changed everything to our house address but now is too late.
I'm not worried about an interview I just want to get this process over with because my grandma is sick and I wish I could go visit her, but I don't want to do it before I get my new residency card.

Anything else you would recommend me send?

Is it worth it sending proofs before the marriage? My husband went to my country to spend 6 months with me and to meet my family, and I have a lot of proofs of trips and other countries that we visited. I didn't send with the i751 package, just sent stuff from after marriage.

I'm not sure that stuff prior to your marriage will help your case.

Get those affidavits from your parents/in-laws, and just explain the mailing address vs. the house address. Be honest about what has happened to the two of you, and let them know the reasons you don't have the items they expect you to have.

Best of luck,

It wouldn't hurt sending the stuff about your husband spending 6 months in your country. More importantly though is bank statements, send as many as you have. Also, tax returns and a written explanation of the unfortunate accident you all suffered. All in all though, be prepared for a possible interview

  • 9 months later...

Hello, I would like to know how the situation went because i am in a similar situation, I got diagnosed with cancer about 3 months after my wedding and i racked up a lot of hospital bills (like $80k) so i wasn't working and couldn't pay any bill, no credit card too so i have little or no document/bill together with my wife
