Request for Evidence - proof of bona fide marriage

Hi,I received an RFE for proof of bona fide marriage and divorce decree from previous marriage(which is easy fix). So far we only have our pics when I went to Nepal,our wedding,our hotel records where we stayed for 2wks then I went back to US bec I was only permitted to leave from work for 2wks. And currently we have records of chats/call thru viber,skype and receipts when we send each other gifts and western union receipts. Would that be enough or is it still necessary to write Affidavits from friends/family? Im wondering if its necessary since my friends/family here in US only knows I got married but they never met him in person yet..then his family in Nepal also met me there and attended our wedding, would what we have right now be sufficient enough? Thanks in advance for any help.

What evidence of the marriage have you sent so far? You say you have certain things but have you sent them already and they still want more? I'm confused.

I would send photos that span a period of time, not a bunch of photos taken on the same day, some print outs of the call and chat logs (again showing a period of time, don't just send the most recent ones), tickets, passport stamps, hotel receipts, etc. Do you have a pension that lists your spouse as the beneficiary should you die before the pension is paid to you? I sent that for our case. Do you have cards or any other mail that had been sent to you as a couple with both names on? We don't live together but my aunts and siblings sent letters and cards for our wedding anniversary to me here but the envelopes and cards were addressed to both of us. Do you have photos of you with his family? Was the wedding announced in a local newspaper? I don't know the custom in Nepal but here a lot of people announce their weddings in the newspaper.

Yes we have submitted some evidences along with the i130 such as pics,wedding,hotel receipts,travel evidences. But its now 4mos after filing I got this RFE for Bona fides of Marriage and Divorce Decree (from previous marriage). We are set to submit more viber chats (after filing),gift receipts,western union. Would that be enough or Affidavits are still required?

My husband and I are using an agency to help us to get through the whole process. They have told us that the pics, chats, phone calls etc. are not much help. Unfortunately we did not have chance to live with my husband yet ( Dating him for a year while he is living in Europe, got married January 16th and now end of March he is leaving back to the US) So we have sent the affidavits, and also pics, chats, emails, tickets etc. even though the agency said we do not need them now, but later for the interview. And now we are just waiting what is gonna happen next.

affidavits are okay but don't hold as much proof as photos do. it's understandable that you guys don't have a joint bank account, insurance etc that can be explained at the final interview. but again, you don't wanna submit too much information and photos at the I-130 stage (carry the most with you to the interview) i believe the reason for the RFE is the lack of your previous marriage's termination - submit this piece of info and you should be set

Pics are not much help???? I hope you're not paying the agency that hold you that. Pictures of the two of you together are about the only proof that you can have that you have spent time together if you haven't lived together. Phone calls are not enough. Chats are not enough. They want evidence of face-to-face contact. Even plane tickets don't proof you've met. They prove you've bought a plane ticket, that's all.

Pics are not much help???? I hope you're not paying the agency that hold you that. Pictures of the two of you together are about the only proof that you can have that you have spent time together if you haven't lived together. Phone calls are not enough. Chats are not enough. They want evidence of face-to-face contact. Even plane tickets don't proof you've met. They prove you've bought a plane ticket, that's all.

Yeah we were surprised when they told us that.. We had bunch of pictures thorugh the whole year from different places plus wedding pictures, pictures of my husband with my family, my friends etc.I even attached receipts from our wedding where were written both our names and picutres of our rings with our name engraved, wedding congratulations cards, my chats with his mom. But the agency said the affidavits would be enough, i did not believe them and told them to send the whole packet which we have provided them. At the end the petition is about to prove the relationship between the couple right. Now we are just praying to get approved. If we discovered this website earlier, we would not need any agency :(

I was just wondering what kind of proof have the couples when they saw each other only twice? I was reading somewhere, i am not sure if it was for fiance or spouse visa, that the couple has to see each other at least twice before they apply for the visa.

Pics of wedding, pics with your spouses family, friends. Pics of you and husband on vacation, or places you went for the day, zoo, museum, park etc.

Chats,emails, phone records, Life insurance on each other, copy of mail addressed to both of you's. Cards people gave you at your wedding is excellent.

Receipts for wedding rings, and cards exchanged between you and him. he should be able to add you to the electric bill or water bill, that is easy to do,

and even add you to his credit cards if he has any. I was able to add my husband to all even though he did not have a S.S. # at the time.

His plane tickets-boarding passes to see you.

Wow, that is a really really bad agency, I wouldn't pay them a penny. Affidavits are like the one thing that DON'T matter. USCIS don't care about affidavits, they want real hard evidence of time spent together such as passport stamps showing trips to see each other, photos of you two together and with family. Phone records, chat logs, emails etc of you communicating is also good bona fida evidence.

OP, don't bother with the affidavits, send the pictures and email/chat logs as well as the divorce decree they were asking for.

Fiancé visa applicants have to prove a physical face-to-face meeting within the two years prior to filing the petition. They only have to have met once. There have been many successful applications here where they met only once. It's quality not quantity. One face-to-face meeting is worth more than a year of Facebook messaging, according to the USCIS. Edited by JFH

We are using an agency and they sent us a request for evidence when we initially sent them our documents. We had photos and plane tickets etc etc but they said we needed the affidavits because we couldn't open a bank account together/don't share property as we live in separate countries and therefore couldn't send them as proof. They sent it off to USCIS after we got them done and we now have our NOA1.

you don't wanna submit too much information and photos at the I-130 stage (carry the most with you to the interview)

I disagree with this statement, if you want to ensure something is seen by a CO, then the time to submit it is with the initial submission with the I-130 as it will become part of the permanent file that ultimately makes its way to the Embassy or Consulate and will be reviewed by CO's prior to an interview taking place. If you save it for the interview, it may never been seen by a CO as it may not be asked for or immediately passed back without so much as a fleeting glance if you try to pass to a CO unsolicited.

With that being said, submit all the information you wish to submit when filing the I-130 and also carry it to the interview so you will have it in the event a CO asks to see it.

Looks like we should have asked for fiance visa, that would be much easier to prove:) We are seeing with my husband every weekend even though we are living in different countries, i am spending with him all my vacation days. he is seeing my family and friends every other weekend and i saw his family at least twice too. so it would be kinda bad if we did not get approved. But also i think the USCIS should understand that we can not have any other proofs except chats, photos, affidavits since we have just got married in January.
