Hello Guys,

i have a question hope you guys can help.

my girlfriend is at guam right now holding a H2B Visa, i think it's a kind of working visa sponsored by her employer bcoz she works at one of the restaurants over there. i wanted to bring her here in the mainland. I was wondering if K-1 Visa will be our best option so i can bring her here. since she's already at U.S Territory.

She has already been admitted to the US. Have her fly from Guam to the mainland. She does not need a K-1 since she has already been admitted into the US.

So i don't need to file for K-1 Visa? from my understanding is that her visa is a working Visa in Guam the H2B Visa, so I'm not sure if that visa is valid going to mainland. Thanks guys for the help.

Guam belongs to the US..... She's already in US territory. You two can marry & file for AOS.

I can see such a thing exists. Can you fly to GUAM & get married. At that point you are married, she entered legally so you can AOS.

I see, i was planning to marry her here in California, if ever we get married in Guam. The marriage Cert would be the same as in Mainland right? its just it's in different U.S Territory which is Guam? or it doesn't matter? also, for applying AOS do i apply in Mainland or in Guam?

First of all, find out if she can travel to the mainland. I understand she can't WORK on the mainland, but can she TRAVEL there? Where the marriage certificate is from does not matter. A marriage certificate is a marriage certificate. It means you're married, period. Even if it was from Swaziland, you could use it.

Either case, there is only one place to file AOS at: you send your package to the Chicago Lockbox.

H2B does not hve geographical restrictions, temp work visa.
