I hard my interview yesterday at Ghana embassy and i was given two sheets.one says we have been temporary refused under 221g and other says i have been found ineligible.what can i do next.i was the first to have finger print done but i was the last to be interviewed..i saw the ineligible paper before i was interview.any advise

Looks like you are in AP - it's not a denial. Did they keep your passport? Did they tell you that they were denying it and sending it back for them to deny it?

Subitted Feb 2-6-15

NOA1 - 2-18-15

NOA2 - 8-18-15

Interview 11-25-15 - Denied

And Here we go again -

New K1 submitted - 1-9-16

NOA1 - 1-12-16 (according to USCIS)

What your petitioner can do immediately : Contact her senator and request through him a second interview, very slim chance but worth a try.

If a second interview is granted petitioner should be on the premises with more relationship evidence.

While most applicants are stunned and go blank it would have been beneficial to ask questions, such as why is my case being returned in

order to get some kind of an idea what is going through the CO's head.

Ask yourself what the questions were and was there anything that the CO said that he doubted you are a bona fide couple ?

Frequent visits are necessary for this embassy. If your petitioner has only visited once then that is likely the problem.

IF no second interview is granted and the petition is returned then USCIS will let it purposely expire and that is the end of it.

You can then start all over again and do a K1 or marry and file a CR1.

Those are your options.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

my fiance had her interview at the U.S embassy in Ghana last week on January 21st, and she answered every question correctly, then she was asked if my family has met her family and she said yes, and she was asked again what they my family came to do and she said they came to perform "knocking rite" as done traditionally when you intend to marry someone. the consular then told her we are married and so she is going to return the case back and so we should filled for as marriage. she tried her best to let the consular know that she is "knocking rite" doesn't mean we are married, but she was paid attention to. My attorney has emailed the embassy for them to give her another interview base on misunderstanding because 'knocking rite' is not marriage and we have not married before not have any marriage certificate, but they haven't replied him back. i also contacted my Senator and she emailed them too to rescind their decision and give her another interview, but no answer back as of yet. Is there any other option out there since i can't filled for her as marriage because we are not.?

No use in having asked the Co why it's being denied. My husband asked and asked after his cr1 was denied and she just kept saying that I, the usa spouse can fight it then turned her back and walked away. She said it was being sent back to uscis. That was back in September 2015. I checked with nvc and nothing has been forwarded to them from the accra embassy. My husband also got the two forms with nothing checked. I contacted my congress woman right after the denial to intervene but it didn't seem to help. Now under ceac he is in ap. It's all confusing and not at all transparent.
