Hi TXR21

I submitted a request on May 7th and I got a response in the mail on May 24th. The letter dated May 19th, so it took them almost 2 weeks just to respond!! And then the letter says my case is still pending and they cannot give me a time frame how long it will take.....well that was a very helpful response...smh.

I haven't received a response at all! ? This whole process is so disheartening!

Now Does anyone has any experience like that, or filed in Houston and end it up on Newark, NJ, or at the worst after you turned your Report Examamination, how soon you got an answer or your green card. Also do you think guys I will have to attend an interview there. Thank you and My apologies for such a huge letter, but Im in great need of sharing this situation. God Bless each of you!

My case was also sent to Newark. Seems like many of these were, which is also a sign you will not need an interview. We received an RFE on 5/27/16, regarding I-693 form (that ultimately was in error) but we sent response in 5/31/16, and then were approved 6/2/2016. So hopefully if you sent in RFE response and it is correct, you will get a quick approval. After approval, we had the card in 1 week. Good Luck!

Sounds like more USCIS incompetence to me. Yes, it does sound as if they just want the vaccination part filled in by a Civil Surgeon. Make sure you get all other parts completed though (except the full medical parts - but do submit the COMPLETE form, including any unfilled pages).

We did not send any of those unfilled pages, because K1s are not required to according to the instructions listed in the I-485 and I-693. In our letter we made an emphasis that we are only required to send out specific pages, and backed this up by sending the I-693 instructions for a K1.

I will agree that the RFE one poster received for the blank pages was sheer idiocy on the part of the officer who clearly didn't understand the rules. Keep in mind that the Civil Surgeon is the one who will stick the required pages into a sealed envelope, so you can't put the blank pages in there anyway.

We sent mailed it in on May 28th. On June 7th the said they were mailing it and we received our card on June 9th.

I would agree that it's just the vax supplement (if you go by the book rules it should be).. the thing is the wording of it throws me. Sounds like you got an absolute idiot reviewing the case if they are talking about varicella being needed if the DS-3025 was filled out correctly. So odd that it says ''medical supplement'' and not ''vaccine supplement'' though. O_o

Things we sent in:

I-693 vax supplement

the I-693 rules highlighting the K1 portion in neon just in case they didn't believe us or they were too stupidz.

A strongly worded letter talking about the rules, explaining that we had sent in a DS3025 already and didn't understand why it wasn't accepted, and acknowledging that we had sent the above I-693 in response.

If it were me I'd do the vax supplement with a CS (ask the CS if they see anything wrong with the DS3025 that might have led the officer to think you needed a vaccine which you absolutely don't). I'd not only throw at them the I-693 rules, but the I-485 rules, the vaccination rules, and the rules of how it should be reviewed.

I can tell you on his DS3025 varicella has been ticked. But for the I-693 the civil surgeon will fill out the form completely differently with a ''VH'' and no tickbox, and you'll have the blanket waiver box checked too. How much time did they give you for this? You could try to go through a congressperson to figure out what is exactly wanted. I bet you this idiot is looking for a VH or something stupid like that.

Thank you all for your help! I found a CS on the other side of town who will do it for $25 thanks to VJ. We have an appt this Friday. It's pretty far away but I'd probably spend that time driving calling people closer to see if they will do just vax so it's ok I guess.

Funny enough (cant remember if I mentioned in my previous posts) the RFE is dated the exact same date as the date my congress liaison inquired with USCIS. Coincidence I say! LOL

I got an email this morning from my congress liaison forwarding an email from USCIS letting her know about the RFE. In that email they did say it was only for the vaccine supplement. But also in that email USCIS says my response is due in 30 days. The RFE clearly says 84 days and due by 9/4/2016. USCIS shenanigans again.

New update. This is just getting silly now.

Last night we got 2 status updates to our case:

5:41pm email - "we have received your RFE response and will review" we haven't responded to the RFE yet

5:42pm email - "new card in production"

I have no clue what happened but I think (hope) this may mean that USCIS somehow realized the RFE was in error. We're going to hang tight on going to the civil surgeon for another few days to see if the card gets mailed.

Hi guys,

Glad to see things have been moving along for some of us, and hopefully they will be moving along for everyone else still waiting!

Anton had the interview yesterday, in Boston, and I wanted to share the interview experience here. He got approved, btw, just to save the drama. :D

The best piece of advice that I can give is: study the questions! Also, don't be afraid to say "I don't remember" - from what I've read, most of us either don't remember something or may give different accounts on the same question. However, having some prep and knowing the type of questions you may be asked puts you in a better position to begin with. I have nothing but praise to whoever compiled this list:

So, here is our experience:

The officer was sharp and professional-looking, though a bit on the stern side. Definitely not the kind of person you'd want to mess with. I got nervous a bit.

He first invited me in, which was good, as I had all the documents sorted. He asked me a lot of questions and got some papers from me, and later allowed me to stay for my husband's interview, on the condition that I would not interfere unless there was a need to help with translation. I've translated 2 words total, each time asking his permission to do so first.

Questions asked:

1) History of relationship:

Names, addresses, names of parents (I completely spaced out on my husband's step father name). Have I met them? Why not? (Hubby is from a closed city, which is next to Russian military base.. ). Where did we meet, what kind of chat room? (We both did our best to explain role-playing games to him; I don't think he fully got it, but our answers were similar enough). How many times did we meet? What did we do the first time we met?

2) Immigration-related: has he ever applied for a visa? When did he arrive to US? (I answered this one with exact date, hubby didn't remember)

3) Marriage: how many guests? Where was that? Did we go on a honeymoon? Which part of NYC did we stay in? (I said Manhattan, hubby said Brookline as this is where we mostly went for walks, but then he said "next to the Twin Towers memorial", so I think the officer understood) What was the hotel name? (I did not remember it and guessed Hyatt, Anton guessed Hilton, but we both said we don't remember it well).

4) Living together: what time do we leave the house? (I said I go at 7-8, because that's what I do most of the time, Anton said 6-9 cause sometimes I sleep in, and sometimes I have really early meetings). Where is laundry located (I said between bedroom and bathroom, in the hall, Anton said on the "3rd floor if you count the garage, 2nd living floor). Who does the laundry? What kind of toothpaste do we have? (I honestly said I don't remember, but I do know Anton doesn't brush, only rinses due to teeth problems, and Anton said the same thing). What do we do socially? What was the last movie that we saw? How did we celebrate last birthdays, what gifts did we give each other?

The officer also seemed to be taken aback by my statement that we did absolutely nothing for Christmas (despite me rationally explaining that we don't celebrate Christmas as my family is Jewish, he kept insisting it's such a big national holiday, and I was mentally like "so what dude told you I'm not Christian I stayed in and SLEPT IN I love my beauty sleep!!") or Valentine's day (we both agreed to ignore it, we exchange gifts and do romantic things when we feel like it, not because it's Febuary 14th). Oh, and Anton confused Christmas and New Years (the later we do celebrate) and said that we went to my parents' place and had dinner, which didn't help either.

The officer was also, I guess, puzzled by the fact that we both insisted that at my first visit we walked around and talked. Period. Well, excuse me, but have you been to Murmansk? Seriously a middle of nowhere city with not much to do, no concerts, or theater events, or anything - and we just like walks, like, actually, like walks. And talking. And each time I'm back in Russia it's a sight for sore eyes to just walk around and hear my native tongue spoken and read the shop's ads and all that. We did all the cultural stuff next time, in Moscow, where there actually are musicals, and amuzement parks and all that. But not in Murmansk, where I took a picture of 2 dudes with chainsaws(!) standing right outside of a supermarket(!) and they threatened to cut us to pieces if I don't delete it off my phone.... that was not the experience that I'd want to discuss with a USCIS office. :)

The officer took our photos and other "proofs" and said we would hear from USCIS in 2-3 weeks, probably, earlier, if he needs anything.

Needless to say, I was a sad little ball of nerves for the next 4 hours, thinking that we may need to do another interview, or be denied, or appeal, or be in AP for a year, like some people on this forum... you know, mentally preparing for the worst.

WHAM, 4 hours later I get an update saying "Your card is in production", and by the end of the day that change to "Your case was approved". YAY!

So, I guess even with a number of differences between our answers (I also said we did nothing on Anton's last birthday, and he said we went out for dinner on the weekend after.. technically both answers are correct, but logically they sound different) we did manage to convey our marriage is genuine, and so are our feelings.

Sorry for a long, long post, I needed this to start breathing again. :D Best of luck to everyone still waiting!

That is very odd, but welcome news. Can the liaison shed any light on this?

The liaison forwarded another email from the USCIS officer the liaison has been dealing with. The email said "Case was reviewed and approved. An approval notice should be received within a week. Please advise Mr. W to disregard the RFE."

So there it is.

I absolutely believe the congressional liaison pushed this through for me. She got someone to look at the file last week. And I think my reply back to her stating that I was confused by the RFE because I believe we've already complied and that his ds3025 clearly shows varicella history checked, if that's the issue, prompted the liaison to follow up with USCIS and them to then take a look at his file again.

I hope that other people are able to see this and reach out to their representatives. They can help.

(I did not remember it and guessed Hyatt, Anton guessed Hilton, but we both said we don't remember it well).

4) Living together: what time do we leave the house? (I said I go at 7-8, because that's what I do most of the time, Anton said 6-9 cause sometimes I sleep in, and sometimes I have really early meetings). Where is laundry located (I said between bedroom and bathroom, in the hall, Anton said on the "3rd floor if you count the garage, 2nd living floor). Who does the laundry? What kind of toothpaste do we have? (I honestly said I don't remember, but I do know Anton doesn't brush, only rinses due to teeth problems, and Anton said the same thing). What do we do socially? What was the last movie that we saw? How did we celebrate last birthdays, what gifts did we give each other?

The officer also seemed to be taken aback by my statement that we did absolutely nothing for Christmas (despite me rationally explaining that we don't celebrate Christmas as my family is Jewish, he kept insisting it's such a big national holiday, and I was mentally like "so what dude told you I'm not Christian I stayed in and SLEPT IN I love my beauty sleep!!") or Valentine's day (we both agreed to ignore it, we exchange gifts and do romantic things when we feel like it, not because it's Febuary 14th). Oh, and Anton confused Christmas and New Years (the later we do celebrate) and said that we went to my parents' place and had dinner, which didn't help either.

The officer was also, I guess, puzzled by the fact that we both insisted that at my first visit we walked around and talked. Period. Well, excuse me, but have you been to Murmansk? Seriously a middle of nowhere city with not much to do, no concerts, or theater events, or anything - and we just like walks, like, actually, like walks. And talking. And each time I'm back in Russia it's a sight for sore eyes to just walk around and hear my native tongue spoken and read the shop's ads and all that. We did all the cultural stuff next time, in Moscow, where there actually are musicals, and amuzement parks and all that. But not in Murmansk, where I took a picture of 2 dudes with chainsaws(!) standing right outside of a supermarket(!) and they threatened to cut us to pieces if I don't delete it off my phone.... that was not the experience that I'd want to discuss with a USCIS office. :)

The officer took our photos and other "proofs" and said we would hear from USCIS in 2-3 weeks, probably, earlier, if he needs anything.

Needless to say, I was a sad little ball of nerves for the next 4 hours, thinking that we may need to do another interview, or be denied, or appeal, or be in AP for a year, like some people on this forum... you know, mentally preparing for the worst.

WHAM, 4 hours later I get an update saying "Your card is in production", and by the end of the day that change to "Your case was approved". YAY!

So, I guess even with a number of differences between our answers (I also said we did nothing on Anton's last birthday, and he said we went out for dinner on the weekend after.. technically both answers are correct, but logically they sound different) we did manage to convey our marriage is genuine, and so are our feelings.

Sorry for a long, long post, I needed this to start breathing again. :D Best of luck to everyone still waiting!

We still have not heard back about the service request. I just logged on to check for an update and it says this:

As of May 20, 2016, your inquiry about why your case is taking longer than our processing time, referral number SR************MSC, is currently not assigned for processing. :cry:

I think I will contact our representative but can I still submit my request?

Can I expedite my immigration application?
My office can submit a request to expedite processing of most immigration applications. USCIS will review these request on a case-by-case basis. In order to have the request accepted by USCIS, the application will have to meet one or more of the following criteria:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS
