Will I lose my Temporary Green Card if my US citizen wife divorce me (or withdraw I-130)

I was feeling unsafe with them and they hid my passport. they gave me my passport at airport only. I wanted to come out amicably so what i did. I have advance parole to go back, and i hope they have not revoked that.

There is one chance of negotiation that my in laws will not do divorce of their daughter, like 1% chance. If they do , then i can sue them in civil court , that they created differences between me and my wife on the basis of money.

What evidence do you have, os the agreement in writing?

I'm thinking that domestic charge will hurt your chances for a green card regardless. But what ticket did you pay? I didn't know charges come with a ticket?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What are you going to sue them for? Hurt feelings? Illegal contract to buy a green card?

You will be laughed out of court. Good luck paying for a US lawyer at $200/hour to fight your case.

Divorce and move on with your life.

Seriously you have no real chance of staying in the U.S. as you didn't complete AOS to have permanent residency. If you had it you would've been in a much better position to able to lift conditions on your own as a battered or abused spouse with evidence of such as well of bona fide marriage intent at inception of marriage. Coming to the U.S. primarily with your AP just to sue your spouse or her family isn't a bright idea as this case is even a weak one. It's even more dangerous as the moment your wife withdraws the I-130 your authorized stay including AP/EAD will become invalidated and you'll be required to leave the U.S. at that moment. Think about it this may happen when your wife even senses you're gonna sue her. The lawsuit will be dead in water before it even begins as you'll be forced to depart the U.S. You'll just spend the little extra money you have on expenses and attorney fees, meanwhile you don't even have a job in India to begin with. You should cut your loses, file for divorce and move on with your life.

What you did not mention was a dowery

As in Morocco my husband was obligated to pay a dowery to me

and he still owes me a small donkey as i saw a cute one and said that is what i want

but on serious side

if you promised a dowery, you need to tell this community so they understand

and i am sorry for you loosing your chances

I will suggest you to get a very good lawyer first to take off the ticket off your record, second your chances to obtain further stay in United States are very narrow.

USCIS do not want to hear how much innocent you are, or you been scammed or abused they only follow the book. Since your sponcer and ticket to your green card pulled back , You can not get a green card.

You better start looking into other countries because upon your return to US you might get deported right back cause you have domestic voilance charges and THEY ARE TAKEN VERY SERIOUS.

Move on, forget about it and start a new life in your home country. Lets say you are in US it will very challanging for you to even get a job because you have a criminal backgound.

You have 2 options here, 1- Move on and stay where you are, or find another country.

2- be ready and drain your money on lawyers and live a very bad life fight for rest of your remaining life.

My concern is that , I married with good intention of making a family, but now my in-laws asking money for giving me Green Card or doing violence. So now Do i have legal rights to protect my green card which i deserve as I am almost near to interview.

As to your situation, it might not seem like that now, but the best thing you did was to take off and get home rather than staying with the abusive people you described.

For your AOS case, you do realize the interview -is there is one- will occur in the US, correct?

Since in AOS, you are the petitioner, you might need to find if there is a case at all, or whether it has been closed if your spouse withdrew the supporting documentation. It is possible, though difficult, to follow thru an AOS case when divorced. Didn't catch if you are or not, and unsure if you know that. You might also need to find that out

His wife is the petitioner. AOS does not make him the petitioner. He remains the beneficiary/applicant.

It's not possible for him to get a green card with a divorce. In fact, without his wife as a petitioner, there is no case. It would be impossible to get a green card.
