Hello VJs,

I would like your input on ths situation, my daughter is traveling to USA on Monday w/ my friend who is on tourist visa, i will not be able to accompany her because of work, i got a clearance from Philippine embassy with my letter(authenticated by the consul here is California), i didnt get DSWD clearance because per rules and regulation below, she is exempted, does any of you had experience like this? i will not be able to secure DSWD because its too late, but i hope someone could give me a feed back.

I am suddenly worried that my daughter will be stop at the departure area, because she does not have DSWD, i have printed the rules and regulation of DSWD and attached it to the clearance she have, and i hope everything will work out. Thank you VJs for reading this message and providing me input and experience.

WHO DOES NOT NEED TRAVEL CLEARANCE? All minors other than those cited above, for example: A minor traveling to a foreign country with either parent or with his or her solo parent or legal guardian; A minor traveling abroad whose parents are in the Foreign Service or living abroad or are immigrants, provided he/she is holding a valid pass such as a dependents visa/pass/identification card or permanent resident visa/pass/identification card which serves as proof that he/she is living with parents abroad and their travel does not constitute child trafficking.

Traveling as a "to follow K-2" a consent letter is the only documentation you will need. But with anything dealing with children, I would be sure to follow with a consent form and back up documentation identifying all parties. I've listed those documents from the DSWD website that would be important.

  1. Photocopy of the birth certificate or passport of the minor
  2. A written consent of both parents, single parent, or legal guardian permitting the child to travel alone or with someone else to a foreign country
  3. Photocopy of passport of traveling companion (if the child is travelling accompanied)
  4. Appropriate document of civil status of parents: photocopy of the marriage certificate of the minor’s parents

You didn't expand upon the document details that you said you had Phil LA Con. sign off on. Therefore I maybe duplicating your efforts with my example below of a consent that I would recommend you use along with some of the items as outlined by DSWD from their website (as noted above), which you have already read.

Consent for International Travel with Designated Adult Guardian

I, ___________________ declare that I am the lawful Guardian of _________________female, born May 4, 2015 at ________________. (City and State or Country)

My child, ____________________has my consent to travel with _________________________ who's permanent address is ______________________________

has a ________________ passport, with passport numbered _______________________ which was issued on ______________ (give issue date) at __________________

to travel to ______________________________ (give your complete address).

I got this form from the consulate here in San Francsico, and it was authenticated by the consul, including my formal letter to the airline.I also attached the copy of birthcertificate of my daughter ( i am the only parent listed in her BC ( no father ). I will keep you guys updated with this journey.

I think you are good to go then.

The excitement to see your daughter is overwhelming about now for you as her Mother. I'm sure she will be fine on her travels. What an exciting time.

i cannot stop worrying because iam lacking of that DSWD blue card, and yes i am very very excited! hope it will be fine with the immigration in the philipines and will allow her to travel with the documents i provided from the consulate.

Does a friend qualify as legal guardian? Just curious.

Actually she is not the legal guardian, she is going to tour in USA, and because she's coming here, I asked her to be a companion of my daughter, I got a letter and a clearance from philippine consulate here in USA and its authenticated, CFO and DSWD says that my daughter is on dependent visa so she doesn't need DSWD clearance. But I am just curious and nervous if they encounter "not very nice immigration officer " and they won't allow her to travel to join me here in USA

CBP (in the USA) staffers see K2's coming in each week, not really pay attention to much more than the visa stamp in the passport and the visa packet that the K-2 is handing over.

I just called the bureau if immigration trunk line in the Philippines and they said only tourist visa minor are being ask for DSWD clearance , and yes good luck to me, because it's too late for us get DSWD , she is leaving on Monday.

Do you not have anyone who can go to DSWD and have the form http://www.dswd.gov.ph/download/forms/travel_clearance/tc%20application%20form.rtf completed today? If not I guess your only alternative is what you have done thus far.

So, have your friend hand the packet and visa of your daughter to the immigration officer and not say anything more than a greeting until spoken to. Answer any questions honestly and with confidence. I would not offer the authorization letter till asked for. Then produce the document. Be respectful.

This is the best they will be able to do. There is nothing here that is illegal, and when asked for supporting documents you have the letter from the Embassy in LA and any additional documents that you have prepared. Take a big deep breath and wait for the phone call that says they are getting on the plane. Then do a dance with some yelping and howling going on. :dancing:

ya, that's that I thought as well,

connecting all of the dots and bits

in that nasty, evil, wicked and mean

if/then/else construct.

ie - the clearance is simply not needed, based on the VISA TYPE.

my note about 'good luck' there in Manila at the airport only stems from the brain dead immigration screeners inside of the airport.
