K1 Visa London Medical - Additional evidence needed!

HI guys,

You are all so helpful, i love this site!

So im a little worried at the moment. Im not sure whether the visa doctors are just being throuough or its a bad sign.

1. Went for my Visa medical ; mentioned history of depression

2. Addtional info was asked for ; my doctor wrote a letter and sent it over

3. Even more information is being asked for......!

- Is there a possibiltiy that they will defer or refuse my visa due to the medical?

- If so, can I still travel to the USA?

- Even though I know people who have done it; is going to the USA , getting married and then applying for the VISA the worst idea ever?

- Is there anyway I can help the situation?

- Can i get the interview date even without the medical? (I know the doctors arent sending it on without more evidence)

As far as I know, Knightsbridge will not send your medical results to the embassy until the medical report is complete. In order to satisfy the requirements for depression/anxiety your doctor needs to write a letter that contains the following phrase "not a risk of harm to self or others". Perhaps they are asking for more information as this was not included in the first letter?


- If so, can I still travel to the USA? Being from the UK, you could still use your VWP whilst this is ongoing, unsure about the consequences if a visa were denied.


- Even though I know people who have done it; is going to the USA , getting married and then applying for the VISA the worst idea ever? This is considered visa fraud and is not a good idea. If you enter with the intent to marry and adjust on the VWP and this intent is discovered, you could face a lifetime ban. If you get married and then return to the UK to apply for a CR-1/IR-1 spouse visa, then this is permitted.





I believe this will be moved to the UK forum where you will get more specific answers from others who have gone through the London Embassy, but if the only issue is the depression/anxiety, a letter with the aforementioned statement included in it *should* clear things up. Good luck.

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

N400

August 8th 2018: Window opens to submit naturalization application

August 13th 2018: N400 Application submitted online 

August 14th 2018: NOA1

September 6th 2018: Biometrics

February 6th 2019: Interview Date! APPROVED!

February 6th 2019: I was asked to return later the same day for my Oath Ceremony! :dance:

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

dont quote me but it depends on wording of what doc sent.

Im pretty sure at this point in the visa process you need to get a travellers visa, also youll be under more scurtiny cause u clearly have intentions to stay eventually

As a back up plan, getting maried in the USA and coming back to the UK will be the next option - dont want to get banned ! lol

I have some comments to add.

The doctors at Knightsbridge must be satisfied you will not be a harm to yourself or others. They can't really know that in one short visit, so they ask your GP for more background. If he only stated your medications for example, he hasn't addressed the "harm" issue. So maybe they got back to him asking more. Sometime Knightsbridge would ask you to have an appointment with a psychiatrist to be assured of the harm issue, especially of your GP won't speculate on your future actions. You never said if you knew what further info they have asked for so hard to guess.

You also asked about going to the US, marrying, and then applying for a visa. I think you mean switch to a spouse visa, right? That isn't fraud at all. But with a spouse visa, you would still have the issue of depression to overcome at Knightsbridge clinic so same story.

If you actually meant go to the US, marry, and skip the visa process going straight to adjustment of status--well that still requires a medical exam in the US before an interview. So you still have to resolve the depression issue before you can live in the US.

Your best choice is to stay on course where you are. Get it resolved with Knightsbridge so they know you will not cause harm to yourself or others. If you had a suicide attempt or attacked your boss with scissors last month, then yeah they could deny your visa. If you were a little depressed or even harmed yourself years ago, it can be resolved if you are fine today.

Edit: Forgot to say to get VWP visits you are asked on the ESTA application if you have ever been denied a visa. A yes, would kick you out of ESTA approval. Then you would need a B1/B2 visa to travel as a tourist.
