hi, how are you? I have a question about I-134. I'm also a student. My dad is probably going to co sponsor for me. Does that mean we each fill out a I-134 and submitt simultaneously, or will we file only one from with both of our information on it? I have a fellowship that is good for the coming 3 years, but I I recieve a taxable stipend, not salary. I also do not have income taxes from the last 3 years. Can my dad sponsor my fiance with out me? Not sure what to do please advise.

As I understand it, with the I-134 your dad can sponsor your fiance himself if you don't have the funds. He would just fill out the form himself and have it notarized and present the evidence requested. You can also fill out the I-134 if you have some income etc. you want to also use for your fiance. When you get to the I-864 then you have a heavier burden, meeting the 125% of poverty and you can fill out an agreement between household members to pool your resources to show you can support your fiance. I believe if you both send in the I-134's then they will count both of you together. I don't think you can count any money you have not already made, whether it is a stipend, gift, income etc.

From what I have been reading you BOTH have to fill out the I-134. I mean how would there be a joint sponsor if there wasn't a main sponsor. I am unemployed right now and have been for 2 years so my brother is going to be a joint sponsor and according to everything I have read. I have to fill out the i-134 and he does as well. Hope that helps.

I'm in the same situation. I've been living in the UK since last June (not working, unfortunately) and will be heading back this Friday until April (not working again.) My mother is going to co-sponsor my fiance, and makes more than enough to do so, but I was still worried.

I'm under the impression both people fill out an I-134. Might as well do it. If you don't and they need it you'll be in trouble.

I'm also going to bring my last 3 years tax returns to show that normally, I do work full time all the time, and have only been unemployed because I haven't been in the country.

The more the better, right?

I am in the exact same situation. I have been in England since June 06 and will be here until June 07, so by the time Rich has his interview I will not have worked for a year. My parents are going to co-sponsor, but if I fill out the affadavit of support, won't I just be putting income= $0 ? I was thinking I could write a letter explaining the situation and that I normally work full time with a decent income and will be as soon as I get back to the US. I am not sure exactly what to do... thank you:)

I'll be keeping an eye on this too. My Fiancee and I are in the UK studying and obviously have no income. My fiancee's parents who are acting out as our co-sponsors have already filled out the paper work (draft) and we definately had some questions!

All,

I-134 is not I-864, and a non-immigrant is not an immigrant. There is no requirement that the petitioner for a K visa must be the sponsor for a K-visa applicant to meet the public charge provisions of the law. An applicant who has sufficient financial resources of their own does not need a sponsor. However, most applicants do need a sponsor and the most reasonable person to be the sponsor, when one is needed in the case of a K visa, is the petitioner.

Whoever the sponsor will be, they must provide financial documentation to show that they can support the visa applicant while the visa applicant is in the USA. This need not necessarily include an I-134, which is optional at the discretion of the consular officer processing the case, although an I-134 is almost always asked for.

Some K-visa applicants in the UK have found that they did not sponsorship information from their petitioner when they offered someone else as the sponsor. But the anecdotal evidence is very sparse. It would be prudent, when someone other than the petitioner is put forth as the sponsor, to have the petitioner's financial information on hand in the event that it is asked for.

The I-134 is required for the K-1 visa. I-864 is for the AOS (once you're married).

Is this only in the UK? And from what I am reading. I also want to make sure I understand. For a k-1 visa the petitioner DOES NOT have to file the I-134 if they don't meet the income requirements they can just have the joint sponsor be the only one filling out the I-134?

As Yodrak says, there is anecdotal evidence at the LONDON CONSULATE of I-134 NOT being required from the petitioner as well the sponsor (when those two parties are different individuals).

That being said I still carried an I134 of my own as well as one for my husband's sponsor. In my case, my income was borderline and I was covering my bases in case the consulate was less than satisfied with my financial picture. They accepted my I134 without question and without any attachments.

The London consulate behaves very differently than most others as regards support, and as such should not be looked to as an example for those traveling on other journeys.

When he goes for the interview. The I-134a says that you may count income that is deposited in US banks. The I-134 is your way of saying that you cab support them so that the US won't have to. I would just get a sponser if I was you. The I-134a is not as strict as the I-864. That is the one you have latter at the AOS interview.
