going on a cruise while on k-1 visa

Me and my fiance is planning for a cruise after a week we get married. By that time our aos is not processed yet. Will i be able to go cruise or i should do the aos first? Thanks

I believe if a cruise ship makes a stop out of the country, it is better to wait until you get at least AP card. My husband and I have planned going to cruise ship as well but we decided will go after we received my green card. Some people suggested AP is not enough but some others said it is okay go to holiday with AP card.

You cannot leave the US without having filed for AOS and receiving AP or your green card first, or you will not be able to re-enter the US again. You would then need to file for a spousal visa to return.

On the I-131 instructions, page 4, section (3)(a)(1):

"You have a pending application to adjust status, Form I-485, and you seek to travel abroad for "urgent humanitarian reasons", or in furtherance of a "significant public benefit", which may include a personal or family emergency or bona fide business reasons".

So apparently even AP will not get you back into the USA unless your travel can be proved to be for one of the above.

You continue to misinterpret the rules. Despite everyone telling you otherwise in your other thread.

Hundred of thousands of people have used AP to go on vacation.

Keep insisting that you are right. Those of us who have navigated the system are dumb and missed what you found.

Good luck. You don't have to use AP if you are afraid. Others should be able to benefit if they want. The rules are clear. You are confusing yourself.

Aaron, I am not interpreting the rules at all. They are there in black and white.

Those are not the rules for DACA, they are the general rules for everyone.

I am not insisting I am right. I hope that I am not right.

But I haven't seen anything from anyone that overturns the black and white rules shown on the I-131 Instructions.

The rules are applied liberally.

Hundreds of thousands sounds pretty large.

And I fully understand that rules may not be applied as stated.

I also understand that the same rules may be applied to different persons differently, and to the same person differently at different points in time.

I am not trying to be PIA, but merely trying to get a handle on the true situation.

It would be good if someone had reference to a clarifying statement from the Immigration authorities on this.

There at over 4,000,000 petitions currently. The US lets in almost 1,000,000 immigrants every year.

Usage of AP is common.

leaving the usa is easy.

the k-1 visa is a one-time use, you already used it to enter the usa.

returning to usa is impossible, your k-1 visa was invalidated prior.

going off the ship at a port of call almost impossible, unless you have tourist stamps for those countries - need extra time and planning to obtain them.

you might get some time if you apply for AP/EAD combo card (forms I-131 + I-765) with the AOS, but you'd have to have the combo card in hand before leaving to the boat trip, and even then, that only allows you back in the USA, is tedious for a PI passport holder to get the tourist visas for those ports of call.

So, if I were in yer shoes, adhering to your calender, I'd simply not go ...

Having a GREEN CARD in hand removes the need to get tourist stamps for the other island countries at a port of call, so keep that in mind.
