I met my fiancé while working in Mexico for a year. I'm back in the States now and am trying to figure out the easiest and fastest way to get her here with me. The only 2 options I know of are the Fiancé visa to marry here within 90 days of her arrival, or the I-130 process, getting married in Mexico and applying that way. We actually have a date of Feb 7th set to get married in Mexico, but we're open to doing whichever method will get her here the fastest. Any advice on this? I had a consultation with an immigration lawyer last week and she told me that all of the processing centers are currently 8 months back on processing the K-1 visas, except CA, which is like 5 months back. But there is no way to know which one it would get sent to. And then I've heard 9-12 months for the I-130 process. Also, any reason to hire a lawyer for this? Can they really be of any additional help to the process? All of the step by step info is out there on the web it seems like.

Thank you for any advice on this as the lack of clarity is really becoming a stressor on us.

K-1 fiancé visa is the fastest. There are only 2 service centers that process the K-1 Visa CSC California service center and TSC, Texas service center.It depends on what part of the U.S.A you live in as to where your petition will be sent CSC is processing faster then TSC now. TSC is a little behind but you can check other people timelines on here from your country applying for K-1 visa and get a rough estimate of how much time that will be

of course if you did the K-1 visa you will have to marry in the states within 90 days of your fiancé arriving.

No reason to hire a lawyer unless your case is complicated. The forms are not that hard to fill out and there are useful info here and people willing to help out

I've filed k1 visa for my fiancé she is only 17! Since I'm 25. So what I wanted to ask is there age requirement on fiancé visa. Because in required document of 1-129f they didn't claify anything so I'm not sure! Help needed

Yes, you need to go see your fiancée before applying for K1. The meeting requirement is important and it's very rare to get a waiver. Also, check to make sure your state legally allows cousin marriage. Some do not.

Skype is part of evidence! You gotta verify if you have bonafied relationship with her. So basically if you have pictures both of you together which is verifying you guys are together. Then you would need itenary, passport stamps,boarding passes.including all call logs,Skype logs.

You answered your own question. The requirement says in the last two years, and it's been nearly four years since you saw her in person. You cannot proceed with a K-1 visa until after you see her again.

Additionally, your case will probably be VERY difficult because of the country you/your fiancée are from and the fact that your fiancée is also your cousin.

No. You need to have seen each other in last two years unless you can provide an extremely good reason why you have not.

Immigration Timeline

 

June 2013: Met whilst working at a summer camp in Michigan 

K1

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

N400

August 8th 2018: Window opens to submit naturalization application

August 13th 2018: N400 Application submitted online 

August 14th 2018: NOA1

September 6th 2018: Biometrics

February 6th 2019: Interview Date! APPROVED!

February 6th 2019: I was asked to return later the same day for my Oath Ceremony! :dance:
