Hi,


I have few questions:


1) My petitioner is a student with no income. What does she have to fill in I-864 part 6 (Sponsor's income and Employment)? Does she have to fill as unemployed? or employed as a student and name of employer her university name?


2) What about current income, does she have to fill "N/A", "0", or "No Income".


3) She never filed for tax as she has never had a job before. Tax info. 2013, 2012, 2011 does she have to write N/A or not required to file? Or what exactly?


4) I have a joint sponsor, now regarding required tax forms, does he have to send me a copy of his W2 form? He has sent me so many documents like,

Form 2848 (Power of Attorney and Declaration of Representative),

Form 8863, Education Credits (American Opportunity and Lifetime Learning Credits),

Form 8880, Credit for Qualified Retirement Savings Contributions,

Form 8888, Allocation of Refund (Including Savings Bond Purchases),

Form 2106, Employee Business Expenses

Form 3903, Moving Expenses


Along with 1040 form, do I have to include the above documents along with 1040 form? and W2 if it is required?

1) Have her fill in Unemployed and Student.

2) For the current annual income bracket she can write "NO INCOME".

3) For the income brakcets for each respective tax year have her enter "NOT REQUIRED TO FILE - NO INCOME" (she'll have to attach a written explanation stating why she didn't have to file taxes for having earned under the threshold - this can be typed up simply with a Word Doc type program, nothign fancy nor notarized)

4) In the I-864 instructions they simply ask for: Federal income tax return, including W-2's and Form 1099's. If the joint sponsor happens to be self-employed they typically don't have the W-2's/1099's and you can attach a written explanation for that as well.

For Part 6, you should select "Unemployed" and select the date when your petitioner last employed (even as a part-time/temp worker). Otherwise, hand-write "Never Worked" in the date box

My Joint sponsor has sent me his W2 he did not mention anything about 1099! And when I googled W2 and 1099 I read that both are for different types of employees. 1099 for contractors and W2 for regular employees. So I think either W2 or 1099, am I right?

Just ask for Tax return transcript from your Joint sponsor...Transcripts are preferred by NVC and you don't have to include W2s or 1099 if you submit a tax return transcript. Your joint sponsor can download tax return transcript for each year from IRS website

My Joint sponsor has sent me his W2 he did not mention anything about 1099! And when I googled W2 and 1099 I read that both are for different types of employees. 1099 for contractors and W2 for regular employees. So I think either W2 or 1099, am I right?

Either no income or 0.00 is acceptable. The important part is that you put in 13.a1/b1/c1 "Not required to file" and attach the letter stating WHY she wasn't required to file.

A person may have a w2 AND 1099. It's better to get the tax return transcripts than send in the entire tax return. It is less paperwork. A self employed person uses their last year's income as their current income FYI.

Thanks for your valued information. I already asked my joint sponsor to have a look at:

And hopefully he can register his name and access his transcripts. Easier than sending around 30 tax sheets.

I really appreciate it NLR. We have already filled the I-864 and followed your advice. And I attached an extra sheet explaining my petitioner enrollment in school till present as full time student.

One more remark here just paid attention to:

My joint sponsor has sent me page number 8 of the I-864 by mail and it is in its way to me. Because it should be handwritten and a photocopy is not accepted by NVC. The rest of the application he filled typewritten electronically and he sent it to me by email. So I will print it out and combine page number 8 with it when I receive it. When I read in the instructions that the bar code at the end of each page will be modified whenever any change is made on the application. There is a problem here. We just found out that there is some mistake in the data he filled electronically on the I-864 and I modified it. Now I believe the code is changed according to the modification made. But page number 8 which was handwritten won't reflect this bar code change. Is there gonna be a problem? Will there be an issue comparing all bar codes on all pages?

To be honest the i-864 and the barcode thing is fairly new and it really isnt an issue. They can still manually look it up. Besides, it sounds like he will be filling out the entire form and saving it, then printing it. (Or printing it and scanning it.) His barcode should match up the entire way across. The only way it wouldn't is if you did the whole form and he signed a page from one he had.
