My I-94 says I left

I'm in trouble. My I-94 says that I left the country. We are going the aos route and I need to fix this before package is sent (sent previously but was able to get it back as something was missing). How can I fix this? I forgot to cancel my return flight with Delta. If I contact them will it help me? I'm just really concerned. Especially if I chose to go back to canada it'll look like I EWI'd.

You will be fine. Just attach a notarized affidavit that says you entered on xx date and did not leave. They will understand it. Out of curiosity, what visa are you adjusting status from and through which route?

B2, through marriage. It wasn't planned. I was going to stay for a week to help him settle things after his mom's death but things got complicated so I stayed. We then decided to marry instead of me returning and doing the k1 process. I didn't even know that my divorce was finalized when I came so intent was def not to marry. I received notice after I came. We thought of me going back and doing a cr1 but I'm now pregnant. I'm expecting a difficult aos due to the divorce turn around. We are considering waiting until after the baby is born to do the aos.

I also have the original bank application dated the 31st of October for our joint account, I am hoping it may dispel the thought I've left. I've also emailed Delta. I just want things to go smoothly

You will not be denied based on an error on your i-94. Like I said above you can either send in an affidavit, or you can go to a CBP deferred inspection site and have it corrected. If there is no rush for your aos, then it would be wise to wait until after the baby is born to file it. Previous divorce + quick marriage after entry + quick aos application may be a little complicated in the eyes of an IO. If you are in a hurry, seek the opinion of an immigration attorney.

You should likely contact a CBP Deferred Inspection Office to inquire about correcting the !-94 record: http://www.cbp.gov/c...rred-inspection

Your case is an excellent "object lesson" to remind people to cancel their return flight, lest the airline rebook the seat and forget to correct the passenger manifest.

Contact Delta on an urgent basis to get them to help.

This is not a good situation to be in; to be somewhere when government contends you are somewhere else.

But consider it could be worse.

Have you read of the situations where a person goes to Social Security office to complain that they didn't receive their last due SS check, to be told that . . . they are officially dead.

Well here we are. That's the usa's so called exit measures at work. Heck, somebody could enter with a two way, stay, never return and USCIS and ICE are none the wiser.

The moment you purchase the ticket that information is sent by the airline about when you were supposed to leave but they do know you didn't leave. Also US doesn't check passports when you are leaving the country but when you arrive in your destiny.

They know you are here as I said before don't worry, it just works like this.

Their computers say if you have one or not even when they ask you at POE about "what's your returning date?" They know everything about you.
