Timeline

What was the type of help the state representative offered then the state senator?

The state rep conversed with me via email and would check in every few weeks or so with me to see if I would like them to contact the embassy. They mostly got the "In AP" standard answer. The state senator called me with the embassy reply and said they would check back in 6 months. I just felt that the state rep was more invested in my case than the senator.

I want to ask something from all of you folks.

In 2011 when my wife's income was not adequate, my brother in law was joint sponsor. He is alone and his income is way above poverty line.

When few days ago, US Embassy called me, the Pakistani lady told me few things. One of it was that your wife's income was less so you need to send an AOS by a joint sponsor.

I told her that my brother in law was already a joint sponsor. She didnt know that and said, wait let me check. After few minutes she found that but I could see that she doesnt have any clue of the facts. Then she said that you need to send tax returns of your brother in law for year 2012. But the information I found on department of state is quite confusing. Here it is

If the poverty guidelines change between the time the petitioner signed the I-864 and the issuance of an immigrant visa, must the petitioner/sponsor and joint sponsor, if required, submit a new I-864?

No, the I-864 remains valid indefinitely unless evidence of failure to meet the poverty guidelines in effect on the date of I-864 filing arises. The consular officer will determine whether the income claimed by the sponsor and documented with financial evidence meets the poverty guidelines in effect at the time the I-864 was filed. If the income claimed does not meet the poverty guidelines then the consular officer may request that the sponsor submit current year income information.

The reason I am asking this is because I dont want to ask my brother in law for arrange his tax returns for the year 2012 or any other year as once he gave AOS, its valid indefinitely. If something is already confirmed then why to ask for another evidence again and again? The lady who was a Pakistani locally employed staff might not be that much aware of laws and regulations. Also cant they check on their own about the figures of tax returns as they both are federal agencies. So please experts reply me about this.

If you want your visa I would not argue with the embassy but instead send them what they are asking for as soon as possible. I am surprised that she didn't know you aready had a joint sponsor. When they asked my husband for a new medical and documents they asked for an updated I-864 from me and my co-sponsor to make sure his income was still above the poverty guidelines.

I would just give them what their asking for, in order to not delay the process anymore.

In sha Allah I would provide them everything they demanded.

But as a general rule, I asked that if my previously submitted documents are convincing then why to submit.

Nevertheless I am waiting for all the documents and I would submit them In sha Allah.

I called nvc 2 days ago and lady named gina told me that embassy is gathering information since your case become current and your medical and ds260 is expired. They will contact you give a week or couple or weeks... i dont know how long will be those couple of weeks.

I had that same person Gina answer my call today, she seems a bit helpful compared to other people at NVC and I think she sees a lot in her system because she knew when my interview was.

She said that my case was moving forward, they are just verifying some information and that they dont need anything right now from me yet. Thats a lot to say compared to the standard your in AP.

Today is a very bitter day. It marks the 1 year anniversary of AP for my fiance's application. Who would have thought a K-1 could linger on for this long. Quite literally it seems that the embassy is simply sitting on it. Last update 22nd December, 2014 and that too was for an beneficiary's address update. Still holding out hope. Such is life.

Try calling between 7am-8:30am I always get through quickly at that time... I've never called at night time but I've heard it's also easy to get through.

Well I heard back from the senator's office , they got the same standard AP reply as well, I expected that, told me they would follow up anytime I asked them too. Medical also expired today too. I see no light at the end of this tunnel anytime soon.
