Anyone have any news on introtucing the new FACTA FORM 8938

HI,

I Have applied for an IR-1 Spouse and children.... reached to a stage of having interviews scheduled for both my son and spouse, and have two questions and hope anyone can advise with any information:

  • The NVC has scheduled as mentioned an Interview date for only two applicants, although the third one is only 5 Years old.. So does anyone have an Idea on what to do??? Am I supposed to take her along to the interview with her brother and mother???
  • Second; Sure most USC living abroad have heard of the new Tax FORM 8938 that has to be filled along with normal 1040 and 2555!!! so does anyone have any knowledge on whether or not we might be asked for it in the Interview???

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

1) did the youngest child have a case too? Is the file still at the NVC? If so you need an interview for this child. Anyone immigrating to the USA must have an interview. (Even a baby has to be present at interview.)

2) I'm unsure about the this but it can't hurt if you aren't using tax transcripts.

thanx , and yes my daughter has a case at the nvc, but what's weird is that her mother and older brother 9 years old were scheduled??

I'm not an expert but I would take it just in case. The Egyptian Embassy is the worst and it's best to prepare as much as you can. I think most likely they wont ask you for it but leave no stone unturned.

Question please, was your case expedited or is it true that it's getting faster to get an interview? It used to take 6 to 8 months then went down to 4 to 6 and lately it seems 1 to 2 months which would be a miracle. :D Thank you in advance and congratulations I'm sure all will go well, God willing.

Nope I never applied for any expediting till my daughters case was missing , and that was done only last week. And also FYI my Priority date ( Received appetence of the I-130) was 04/20/2013.

So its been way over the normally estimated time frame, and that was due to lots of RFE's they asked for.(Police Reports, Old Egyptian Birth Certificate and not the electronic one { it toke me a hell of a time to convince them that Egyptian birth reports have been changed into the new ones and that old ones no longer are available!!})

Ok thank you, this is great news it means they speeding up and are with the majority of Embassies now. So sorry you had to go through so much it seems a whole group of us got stuck in one way or the other :( . Much luck to you and I hope you come back to let us know how the interview went.
