I-485 Denied ( Didn't go to the Cancelled interview)

Got denied because I didn't appear for the interview which was cancelled (received cancellation through e-mail and snail mail). We are supposed to still go to the interview (cancelled) but we can't bec of the terrible ice/snow storm last week. So we thought since we got 2 letters cancelling my interview, they might be sending new appointment soon. BUT BAD NEWS my AOS denied!!!!!!!!!!!!!!! bec of non appearance that they cancelled!

To those who are on the same case or have been on this situation...PLEASE ADVICE me what to do now! We are so DOWN and WORRIED!!!

A lesson learned in the future and anyone please advice us!!!!!

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Hmm,

I don't know. I suppose if it were me, I would make an infopass appointment, but then also go down the office if there was not an available appointment for a while.

Seeing as it was their error and not yours, you shouldn't have a problem getting a new appointment. If they give you a hard time, try contacting your senator/congressman.

If you can get an Infopass appointment quickly (within the next couple of days), then I'd do that. Some have said that checking into the Infopass system later in the evening, like around 9 or 10 pm, you might catch an appointment time that someone else has cancelled. But if you can't get an Infopass appointment promptly, I'd go down to the office myself and wait in line and explain the situation thoroughly.

We missed our appointment and I was down there at the USCIS office the next day. I waited in line, without an Infopass appointment, and got to speak to the IO at the front desk. She told me to write a letter to the District Director explaining what had happened (in your case, if they ask you to do this, definitely include copies of the notifications they sent you saying the appointment was cancelled), and requesting the interview be rescheduled, and mail the letter to them. They would not accept a hand-delivered letter at the USCIS office. So I mailed it registered mail.

Also, just a personal opinion here, I would not take an attitude with them or remind them that it is their fault. They will see that from your documentation. I would just communicate that you are very concerned and a little confused and you would just appreciate their help getting this straightened out. Or something like that. I think they are more likely to help you if they don't feel attacked or accused.

I would do both! Make an Infopass appt. and go to the office asap. If you get a response when you go in person, you can always use the Infopass to follow up.

And kill them with kidness and a smile. Like maya said, don't accuse them (even though at times we would like to ring their incompetent little necks!)

I totally agree. My interview was cancelled but I made an infopass for the same day in order to 1) confirm the cancellation and 2) get information on our case and the refusal to give us an EAD (interim). And be nice as they recommend. I am ready to lose it but I find that when you say "thanks so much, I know you're trying to help etc" it works!

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Do as the others have suggested with an infopass and getting to the office. Also contact your State Senator/Congressman, just to make sure you are covering yoruself. It isnt your fault if they have cancelled the interview and you should not be penalised by having to file again. Hopefully they will just reopen your case.

Oh Warren, sorry to hear that. We were in the same boat with the cancelled interviews - luckily I went to mine after I heard they were denying people who didn't turn up to cancelled interviews. This totally sucks and I could have so easily been in your position.

I don't know what to suggest but I guess an immediate infopass appointment would be a good place to start. Let this be a warning to anyone else who gets a cancellation notice - call your local office immediately to confirm the email/letter or better just go along to the "cancelled" interview. I managed to get my greencard after attending a "cancelled" interview. It's ridiculous.

You have a very solid reason (with very official evidence) for the reason your 'missed' your appt. I'm sure that you can easily get this ball rolling again at the infopass appt.

Another thing I forgot to say: document, document, document!

Keep a log of any phone calls, attempts at Infopass appointments, visits to USCIS with or without appointment, emails, COPIES OF CORRESPONDENCE (and I would send anything they ask for by registered mail/return receipt requested). Write down names of people you talk to, as well as dates and times.
