Good day/evening to you all. Here's my question. We got an RFE and among the things listed of the evidence I submitted they said this; it states "copies of joint federal and state tax returns, however, you have not provided evidence that these tax returns were received and accepted by the appropriate entities". Ok, what? That threw me wayyy off. Im figuring they mean they want to see proof of us depositing the checks we got for the tax returns or something to that extent. But I really don't get it. I guess copies of our joint tax returns with our signatures on it aren't enough? Also, Im going to be submitting some affidavits and it states it should be supported by "documentary evidence". Wondering what exactly can be considered that. I was going to call immigration but its friday and its late and well I never get home early enough to make that call. I appreciate the help anyone can provide. Thanks.

Go to IRS.gov and request your tax transcripts. That is proof of the tax filing. What all evidence did you provide? Did you send utility bills in both names, lease or loans in both names, proof of joint bank accounts, insurance with the spouse listed as beneficiary?

They do not want proof that you deposited tax refunds. They want proof that you filed jointly and it was accepted by the IRS. Free transcripts work for that > http://www.irs.gov/Individuals/Get-Transcript

Thanks for the info on the tax returns Kaydee and Belinda! In regards to the other stuff, I didn't have much to begin with. Sent pictures. Joint bank account statements. Health insurance cards. It's really lacking. There are unfortunate circumstances as to why and I knew we were ill prepared. But we can only move foward. I was expecting the RFE. Don't have utility bills in our names. No leases. Insurance is Medicaid so I don't think either of us would be listed as beneficiaries I'll check it out though.

Well it sounds like you didn't give it your best shot the first time around, so give it a better shot this time.

They wont to know that you lived together. So whatever you have regarding that, put it in with an explanation of how it shows you lived together. They want to know you combined finances, so put it in with an explanation of how it shows you combined finances. If no lease, where did you live, and how can you show you lived together? It's not uncommon to live with family, so get a letter from whomever owned or had the lease on the home. Did you note the date and place of the pictures on an index or on the back? The joint tax returns are the easiest part. (I've never understood why they ask for these. There are lots of legally married couples who live apart and have little to do with each other but still file joint tax returns. All it shows is that you're not foolish enough or angry enough with each other to pay the higher married-filing-separately rates.)

If you don't have what they will be looking for, walk them through why what you have will show them what they want to know.
