Can you file to work as part of your AOS before finishing your I-693?

Hi everyone,

My wife recently came over on a K1 visa from the Philippines. We are about ready to file the AOS so she can work (she already got her SSN). However, when I got to the I-693 part, I realized it's going to be a delay while we find a doctor and do the immunizations and all that. What I am wondering is whether there is anything we can do to get her working in the meantime. It's not really that we need the money as much as she would like something to do (she's in the house all day while I'm at work). Seems like if we wait to go thru the whole process with the surgeon, it will be many weeks before we can really file the AOS packet...

If your wife's DS-3025 is properly completed and she had her medical within the year, you don't need to look for a CS and file an I-693. Most of the time, K1 visa holders from Philippines need not need to file an I-693 unless there's a medical concern or any missing required vaccination on the DS-3025. To answer your question, unfortunately your wife can't work until she received her EAD (or GC, whichever comes first). You can look for volunteer activities in your community that might be of interest to your wife, but there should be no pending remuneration or compensation in exchange for her efforts.

In most situations the I-693 is not required, all you need is a copy of the DS-3025. Read the I-485 instructions, page 4 section 7c, in fact I suggest you make a copy of that page and highlight that section, then staple it to your copy of the DS-3025 when you send the I-485 to USCIS. And of course file for EAD & AP as both are free to do so at that time.

EAD/AP card takes 2-4 months on average.

Is it possible that she would not receive a DS-3025 at St. Luke's. My wife says she did not remember getting anything from St. Luke's, just a "CD" and a packet that was not to be opened. Does this sound right?

She has to check her files again. SLEC always gives a DS-3025 and a CD after a successful medical of an applicant.

She seems sure she did not receive it. As for the packet, they opened it when she got here and kept it apparently (not sure if that's what normally happens).

Would we have to get a copy of the DS-3025 now? Or how do we replace that, do they have it on file?

She must be talking about the "sealed DO NOT OPEN visa packet" that everyone surrenders at POE.

No, you can't replace a DS-3025, and I have no idea if SLEC can release a new one, since her medical report has been already forwarded to the embassy before her interview. You're probably looking at 2 options:

1.) If she's certain that she had all the required vaccinations at SLEC during the medical, you guys can probably just risk and make a note in your AOS cover letter that she had her medical and that she has no DS-3025 copy at hand. This is in knowing that there is a medical file with the visa packet.

2.) Get a full medical from a CS and the required vaccines (even the ones she had at SLEC unless they run immunization tests, because she has no proof), which is really costly.

The first option is risky and might give you a RFE since it has been notoriously known that uscis sometimes misplace the medical file. The second option is not actually necessary, but just simply removes the RFE possibility. And I'm not really sure about the repeat vaccination thing. It's really up to you guys.

P.s. If I were her, I would try to check into my files again to look for the DS-3025.

Even without a copy of the DS-3025, they still do not need a new medical. You do not have to get a new medical if yours was done within a year of filing for AOS. That is not tied to whether or not you got a copy of your vaccinations that were done at the K-1 exam. Some consulates do not even give vaccinations or a DS-3025 at the K-1 medical.

OP > File with the note in your cover letter stating that she had her vaccinations at the K-1 medical exam and that the DS-3025 vaccinations sheet is included in her file along with the other medical documents. IF you get an RFE for vaccinations, then worry about trying to find a civil surgeon that will not insist on a new medical and do just the vaccinations for you.
