Should I fill I-864 or I-864EZ with additional rental income?

Timeline

I am trying to figure out if I should fill I-864 or I864-EZ. My qualifying income in salary is enough to cover requirements but I also have rental property. Does this mean I don't fullfill the 3rd criteria list as below?


  • all your qualifying income comes from a salary or pension and shows one or more W-2 Forms that you receive

I do meet the other two conditions here but not sure about the above. I think I do meet the above but I don't want to get a checklist.

Jun 3, Recieved email that AOS/IV fees are paid and I need to send the papers which I have already done.

July 3, Received postal mail from NVC that my visa preference has upgraded to CR1

July 8, Case Complete

April 04, /2014 I-130 Send to NVC

I asked myself this same question today. Part of my income last year was W-2 and the rest was 1099 (business).

I opted for the I-864 over the I-864EZ because mine was mixed. Hopefully someone here can confirm that this was the right move.

I am posting answer to this myself having researched and been through the process.

If you want to be perfectly on safe side than file I-864 because it is the universal version anyways. However when I tried to fill it, it was long and more complicated then the EZ version and I quickly gave up.

I had used the EZ version and today my case was complete without checklist so that's a great news. I know at least one other person through VJ forums who was also in exactly the same boat and had filed I-864EZ and didn't get the checklist.

I had send in (as part of AOS package) my complete tax returns of this year including Schedule E (which is a plain sheet of paper prepared by H&R Block Tax professional - it is part of taxes with rental income I believe). The income amount I put was my total income from tax return. Make sure you put exactly the correct income because people get checklist for this!

Baltoro, what did you put in part 3 (place of residence) question, did you rewrite the address or just put N/A? I rewrote my place of residence instead of writing N/A there, I hope I don't get checklisted for rewriting place of residence which is same as mailing address.

I don't remember 100% but I think I put in address. My motto was to avoid even putting N/A if possible. I am sure you will not get checklist for at least this one, good luck with rest of the form.
