URGENT RESPONSE IS NEEDED TO THIS K3 CASE PROBLEMS

HELLO VJ FAMILY.

I NEED SOMEONE TO HELP ME WITH MY CASE, I HAVE BEEN DENIED A STUDENT 3 TIMES AT THE EMBASSY AND FIANCE VISA 1 TIME AT USCIS OFFICE IN THE US.

MY FIRST ISSUE NOW IS THAT MY LAWYER WANT TO KNOW WHY I WAS DENIED MY STUDENT VISAS WHICH I ONLY REMEMBERED THE FIRST ONE WHICH SAYS I DIDN'T DEMONSTRATE THAT I WILL RETURN HOME AFTER MY STUDY AND HONEST I COULDN'T FIND ALL THE DENIALS. ALL THAT I REMEMBERED WAS JUST THE WHOLE DENIALS WAS UNDER SECTION 214 B AND FOR MY K1 VISA APPLICATION WAS DUE I NEVER GET TO MEET MY FIANCEE IN A PERSON AND SHE MOVED ON WITH HER LIFE WITH SOMEBODY ELSE.

NOW MY LAWYER NEEDS ALL THE DENIAL PAPERWORKS I CAN ONLY FIND THE ONE FROM MY EX WHICH WAS FORWARDED TO MY EMAIL AND NOT THE STUDENT VISAS DENIALS.

NOW I AM MARRIED TO SOMEONE NEW WHO IS ALSO AN AMERICAN WHOM I TRULY LOVE. I HOPE ALL THIS PREVIOUS DENIALS WILL NOT AFFECT MY K3 SPOUSE INTERVIEW PLUS THE DENIALS PAPERWORKS THAT I COULDN'T FIND??? BECAUSE WE ARE ABOUT SUBMIT OUR DS260 AND I WILL WAITING FOR MY INTERVIEW DATE ANYTIME FROM NOW.

PLEASE I NEED YOUR ADVICE AS SOON AS POSSIBLE.

IT IS VERY URGENT I CANT SLEEP HERE.

You've established that you're trying for any visa possible to get to the US, including throwing out a Hail Mary K-1 that any minimal amount of research would tell you wouldn't be approved on grounds you've never met. Very coincidental that you've met not one but two women in the US that you love and just can't be without.

What does a visa denial under INA section 214(b) mean?

This law applies only to nonimmigrant visa categories. If you are refused a visa under section 214(b), it means that you:

  • Did not sufficiently demonstrate to the consular officer that you qualify for the nonimmigrant visa category you applied for; and/or
  • Did not overcome the presumption of immigrant intent, required by law, by sufficiently demonstrating that you have strong ties to your home country that will compel you to leave the United States at the end of your temporary stay. (H-1B and L visa applicants, along with their spouse and any minor children, are excluded from this requirement.)

You have to overcome the appearance that you just want to get to the USA with your past denials.
You may find yourself in long AP where they will look deeper into your case.
I hope all forms were filled out truthfully and answered as best you can remember regarding the previous applications with an

attached sheet stating you do not remember specific dates of the student visa apps if you don't.

You have a rough road ahead and it won't be easy.
Your case may be returned with recommendation to revoke but you then have a second chance to rebut their findings and

try to overcome them.
They have all the dates of your previous applications in their data base and will compare your answers with the current one.

Any 'inconsistencies' can be misrepresentation with a life long ban.

Lagos is one of the toughest consulates and if they have any doubt about the bona fide of your relationship you won't be approved
the first time around.
Other things are very important, such as how long did you marry after you met, how many times did she visit, what was the time gap
between your first K1 and your current petition, how much of an age gap is there.......etc.
I would say that the filed petition with someone who you have never met face to face before will be your hardest hurdle to overcome and is a fraud indicator in your case, not in every case but definitely in your case.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Already some good answers, but the OP should be aware he is applying for a CR1 visa, not a K3.

OP.....NVC will administratively close out the K3 and you will be following the CR1 path.

K3's are no longer a viable option.

What are the timelines of all your denials. Like others have said you have shown you really want to come to US and it may look like by "any means necessary".

Thank you very much VJ family and I really do appreciate all your comments, I will like to know If getting like a recommendation letter from my ex can help? Because she moved on with another man when the K1 visa application didn't get approved and I felt so bad at first but later I understand we are just friends now nothingg but friends.
