Inadmissibility issues on I-129f

My packet 3 email said they'd snail mail a copy of my approved petition to me. Well, it arrived today and on the first page of the I-129f form under 'remarks' someone hand wrote 'inadmissibility issues'. Needles to say, I'm... not great. Anyone else ever got this? Is it really standard procedure to forward a petition like that?

Issues I can think of:

1) I applied and was refused a student visa last December. I actually went twice within a week. They asked who I'd be staying with and I said my girlfriend. They asked a few questions about her, then denied my application and revoked my tourist visa. The first CO said he doesn't think I'm a bonafide student but that I could apply again, the second said I don't have enough ties. We discussed our options after this and decided to get married and filed the K1 paperwork on Jan 3rd.

2) I got pulled into secondary when I visited her for 7 weeks during summer break last year (I was still a student). We were still only casually dating at that point and not really in a relationship so I said I'm staying with a friend. They didn't ask any more questions about that, but seemed concerned that I would work, which I didn't.

3) In Croatia we distinguish between permanent and temporary residency. I was stupid and only put my permanent residency on the G-325A, even though I was a student in another city in the same country for much of the last 5 years. I'm scared they'll think I wasn't a student and lied (even though I of course had to bring paperwork from uni when I applied for tourist visas), or that I purposefully lied about my residence. I plan to bring an updated form to the interview but don't know how much that will help.

Our relationship is genuine and we do have lots of proof: 4 visits, skype chats every day, cards, emails, texts... She's coming to the interview with me.

I don't even know what to ask. Has anyone had a similar experience? Any word of advice?

K-1 is for unmarried couples.....if you've become married, then it was the incorrect visa to apply for...should have been for the CR-1.

Not a big deal.

Many folks list a more permanent address if their school address will be temporary.

Have to prove to the Embassy CO.

Seems strange......so the Embassy sent you this marked up copy of the 129f? Never heard of this. Contact the Embassy and inquire.

We're not married. We just got engaged (decided to get married). And yes, I found it strange that they sent it, but I'm glad for the warning.

I also did not know some consulates would send you a copy of your approved petition that the USCIS has made notes on. Never heard this before. You have that heads up now though. Bring plenty of evidence that you are a bona fide couple. I believe the note is because she tried for other visas that were denied and they are wondering if the K-1 is to simply get her into the US. You can overcome the suspicion with solid evidence. Bring anything and everything you possibly can that spans the entire length of your relationship to show you are a real couple. Both attending the interview together is helpful too.

Yes, there was a member here got remarks on her approved petition with handwritten. She then told me that she got denied F-1 visa and was freaked out that would affected her interview result. Turned out, she was okay and her visa was approved. So, don't worry.

Contrary happened to me though. After she told me her experience, I had expected would have same remarks after my B-2 visa was denied in 2010. Back then, they gave me a yellow paper stating "consider filing petition for K-1 visa". Weird that after I checked my packet 3, I did not get any remarks on my I-129F about previous visa refusal. I then told her and she found that was weird as well. She is from the Philippines but her case was forwarded to the US embassy in Jakarta.

Yes, some of the US embassies/consulates sent the beneficiaries a copy of I-129F with some marked on it. I got one.

Yes, there was a member here got remarks on her approved petition with handwritten. She then told me that she got denied F-1 visa and was freaked out that would affected her interview result. Turned out, she was okay and her visa was approved. So, don't worry.

Contrary happened to me though. After she told me her experience, I had expected would have same remarks after my B-2 visa was denied in 2010. Back then, they gave me a yellow paper stating "consider filing petition for K-1 visa". Weird that after I checked my packet 3, I did not get any remarks on my I-129F about previous visa refusal. I then told her and she found that was weird as well. She is from the Philippines but her case was forwarded to the US embassy in Jakarta.

Thank you so much! That's such a relief. :D So they do send approved petition copies. Just to check - they wrote 'inadmissibility issues' on her petition? Or was it something else?

Yes, I believe that was the reason of remarks. One member here got remarks on her I-129F that included to packet 3. She got denied F-1 visa and when she had her interview, the CO asked her why she chose a university that close to the place where her fiance was lived. It raised up the suspicion that she applied F-1 visa just to get closer to her fiance. Her visa was approved. The US embassy in Jakarta sent me a copy of my approved petition without handwritten remarks on the box except some ticks marked on it.

Yes, I got one and attached to my packet 3. So don't worry. I believe it says, " F-1 refusal". But I guess it would be different remarks based on prior visa applications. She got a lot questions from the CO about F-1 refusal about why she chose a university that close where her fiance was lived. Her K-1 visa was approved, anyway.

In my assumption the reason why I did not get one since I applied B-2 visa and they assumed I will use this visa to get married in the US because I put my then-boyfried (my now fiance) as a person that I was going to visit. For her, the CO probably got suspicious that she disguise her intention to marry her fiance by using F-1 visa even though she never had intention to do so. She put her aunty as a person who will funding her study not her fiance's name.

I can't add much more but after doing some reading online I think it's probably the denied visa that caused them to write that on the form. It's good to know other people had the same issue but were approved anyways!

Like the others said, just bring a lot of proof that day. It's great that your fiancee will be there with you! That'll help for sure.

I'm also waiting for my interview so even though I can't give you any valuable information (I wish I could!) I wanted to wish you luck! :) I won't tell you not to get nervous because that's easier said than done :P I'm sure I'll be pretty nervous myself!

I-129F NOA1: Jan 3rd 2014 (notification received by e-mail and text message; hard copy received on Jan 10th)
I-129F NOA2: Jan 27th 2014 (notification through USCIS mailing list; hard copy received on Feb 3rd)
NVC Received: Feb 07th 2014 (verified through phone call; no notification received)
NVC Left: Feb 11th 2014 (CEAC status changed to "in transit"; called NVC to verify)
Processed at Consulate: Feb 20th 2014 (I sent the embassy an e-mail on Feb 18th and they replied Feb 21st saying that they had received my case the day before)
Package 3 received: Feb 21st 2014 (sent by embassy through e-mail attachment; it was a Word document; they usually send it through regular mail)
Package 3 sent: Feb 24th 2014 (received at the consulate Feb 25th; I know this because I sent a certified letter with online tracking)
Interview date: April 30th 2014 (notification received by e-mail on March 21st; hard copy received on March 26th)

Update!

Called the embassy today and they were very helpful. The lady said they have to forward the petition to me by law (croatian law, I guess) and that the inadmissibility remark was there because my tourist visa was revoked and not to worry. My interview is set for the 15th.

We had actually sent a copy of the revoked visa with an entry stamp as part of proof of meeting in the last 2 years. I'm guessing whoever worked on our petition saw it was cancelled, but didn't know why. Looks like uscis can't see or doesn't bother to look up embassy notes.

I'll post if this is brought up at the interview.
