I assume I probably will receive a letter which tells me no bio need and I am just curious in that case, is USCIS going to refund my bio fee? Probably not...

I will call and find out that on June 5th though!

Hi guys. I filed for I-751 April 23. As of today haven't received any biometric date. Last week I emailed a service request and 3 days ago called USCIS. They said they'd put a service request and wait 30 days. If no response then to call them back. Today I received this through email. So I guess I just wait now or is there a way I can get a case number to check the status of my wife's green card?

The status of this service request is:

The required biometrics for your Permanent Resident Card have been successfully uploaded from a previously filed petition/application. Therefore, an appointment at the ASC is not necessary.

USCIS never ever returns any fees paid. Its your fault for paying for a bio you didn't need, which if you had not paid for with your application, they would have returned it.

USCIS never ever returns any fees paid. Its your fault for paying for a bio you didn't need, which if you had not paid for with your application, they would have returned it.

Yeah, I already expected they would say like that but I just wanna say how am I supposed to know that? Obviously it is not clear...sigh :cry:

Which is why I say the unpublished change in policy of USCIS, and it does appear to be a real change in policy being reported. Previously I used to joke that the bio on ROC was needed to prove us USC's didn't swap out our K-1 spouses, but maybe USCIS figured out it was a joke to.

If our chart here included who came on K-1 and who was CR-1, it might be easier to make sense of this. We might even be able to lock onto a date when the change was began. Lacking an official word from USCIS on a policy change, we can only guess what's going on right now.

I'm really not sure, but I'm beginning to believe if you came on a K-1, your AOS bio is good. In the past you would have definitely needed it. Those of us who filed early in the month all got the bio letter. But now everyone is starting to report no bio needed. Which is why I say the unpublished change in policy of USCIS, and it does appear to be a real change in policy being reported. Previously I used to joke that the bio on ROC was needed to prove us USC's didn't swap out our K-1 spouses, but maybe USCIS figured out it was a joke to.

If our chart here included who came on K-1 and who was CR-1, it might be easier to make sense of this. We might even be able to lock onto a date when the change was began. Lacking an official word from USCIS on a policy change, we can only guess what's going on right now.

Well my mention of the K-1, is because they generally had their last bio slightly over 2 years ago. The previously published maximum age for a biometrics to still be valid was 15 months. Meaning all K-1's and CR-1's in the USA needed the biometrics when filing to ROC. They've apparently extended this period, maybe something to do with the all electronic biometrics system they've switched to has been fully in place long enough to extend the valid period? It's all guesswork at this point.

Its sad but No they wont refund Bio fee!! Just don't keep any hopes and don't waste your time calling them for that :P

i think we should mention it there as "CURRENT" or "WAIVED" just so that it doesn't takeup too much space.

I guess no you have to wait for your 10yr GC.

Give us your ROC package sent date and NOA1 receipt date we will add you to April filers list.

Once hey said no need of BIO then most likely they wont ask you for BIO.

Yes i came on F1 and the last time i gave my BIO was little more than 2 years.

i will be calling USCIS on June6th to find our my case# and status.

05/25/2018: Received NOA Bio-metrics for I485 Appt: 06/10/2018

06/10/2018: Bio-metrics are completed

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected

I wish they would return your money!! lol. Once you pay them its their money not your :( I know its not right & its USCIS's fault not letting us know in reminder letter who needs to pay for Bio & who is not. Seems like they loveeee our money.... :rofl:

Call them and ask for Tier 2 department. They can help you get your nee case #. Keep in mind you have to be really demanding otherwise they don't like to transfer your call to tier2.

Yeah its their fault. Even if they told you that you don't need to pay for Bio , would you give them free money?

My case number still does not show that it has been entered in the USCIS system? I am using the number provided on the USCIS biometric letter.

Its strange. The case # on the Bio letter should work.

i think we should mention it there as "CURRENT" or "WAIVED" just so that it doesn't takeup too much space.

you have to submit the Bio fees it's mandatory even if you have a current one. if you have a current bio and you didn't submit the 85 $ , your application will be rejected.

Hi everyone,

Please add me to the list. We sent the I-751 on 04/23, NOA1 receipt date is 04/28/2014. I came to the US on an F1 visa and got my green card through AOS. I'm also still waiting on a bio letter, but after reading here I might not receive one?? I did my original biometrics appointment in April 2012, so it's over two years... I've been trying to call them and talk to someone at USCIS. Can you help me with how to call? The numbers I'm using are 1-800-375-5283 or 1-877-247-4645 (military hotline). It never gives me an option to talk to a CSR though :( Is it maybe because I'm calling too late (Hawaiian Standard time is 2 hours behind PST)... I would really appreciate it if you could tell me about how to get past the annoying automated menu options lol
