I wanted to find out if there are others out there who have been waiting as long as us for our AOS from K-1 visa. We sent in our AOS package on December 11, 2012. My wife did biometrics and got her EAD/AP card pretty quickly. In August 2013 we received a "Notice of Potential Interview Waiver Case" letter. The letter said that our case would be delayed by approximately 6 months and to call USCIS after that if we still didn't receive a decision. After six months had passed I called them. The representative I spoke to was very nice and said that he would start a ticket number and that they would send a letter explaining why our case is taking so long. But all the letter said was:

"Our records show that your I-485 Application is currently pending adjudication. We regret that we are unable to provide you with a completion date at this time. We apologize for the delay."

So that was useless.

My wife's EAD/AP card has just expired. I sent in applications to renew it about a month ago but we haven't heard anything regarding those cases yet either.

I'm just wondering, are there are other people out there waiting as long as long as us? Is there anything that others have done that helped to get a decision?

Our application was received on December 11, 2013 and we have our interview March 5, 2014 so our wait was not long at all. I wonder if there are certain criteria, like income or notes from the K-1 interview that put individual applications onto a fast or slow track?

Have you contacted your congressman and had them inquire on your behalf? It was very helpful for us. We were getting close to the one year mark and as soon as my congressman looked into it we got approved - could have just been coincindence... but it is worth a shot.

No. It appears to be random as to whether or not a case is waived an interview. About a 50% chance or so. Those not having an interview are waiting longer due to backlog. Some that get interviews wait longer then others because how soon they get an interview date depends on the backlog at their local USCIS office. It is not about income or otherwise. The only thing that can slow some people's cases down and not others is getting an RFE for something that delays your case.

It depends on FBI checks. Nothing about offices busy, watch time lines for same office and you will see that some have the process very quickly when some are giving excuses like backlog.

Some that get interviews wait longer then others because how soon they get an interview date depends on the backlog at their local USCIS office.

Yeah I was reading a USCIS article sometime and the most likely reason stated for lengthy case adjudication times was due to FBI background checks. Most checks come back pretty quick but there are those 1% or so that take a long time to complete and until background checks are completed! cases can not be adjudicated. They stated reasons for how they will be compelled to expedite such cases though and I remember one of the reasons being the applicant filing a writ of mandamus. In this case, they will have to authorize the FBI to exclusively expedite such checks regardless of whatever is holding them back.
