AOS packet advice for NVC?

Hi VJers!

I have a question. In September of 2013, my position was eliminated at my previous employer. I received a severance and found a new job that started in November.

I have not filed my taxes for 2013, and I understand that it's ok to send my 2012 tax transcript. So for my AOS packet, I plan to send the 2012 tax transcript and an employment verification letter from my current employer.

My question is... would it be smart to include W2s from 2013 from my previous and current employer? I may be overthinking, but I'm afraid they'll see that I started working in November of 2013 and will want to know what happened before then. With my W2s, the NVC will be able to see a better picture of my 2013. Also, I was a little confused by the instructions for the AOS packet because it says if you send your W2s you have to send other tax forms for 2013 (but I think it just referred to those who send the actual tax return, and not the transcript).

My annual income at my previous employer and my current employer each was/is above the poverty line, so it's not a matter of combining. Just concerned the NVC will send me a checklist trying to figure out my income before Nov 2013.

There's no need to include W2s for 2013. Especially if you're using 2012 as the last tax year.

If you earned more income in 2013 though, you may want to consider filing your taxes and sending in a copy of the tax return (as well as the W2s, schedules, worksheets, etc), if you can't get the tax transcript in time.

There's no need to worry about your 2013 employment. People get fired/quit and find a new job in the same year all the time. If you wish, you can explain it in the cover letter, but it's not really needed.

I did earn more income in 2013 especially because of the severance, but my 2012 income was also above the poverty line so I'm not so much concerned with that. My main concern was how the NVC would judge my recent change of employment. It's probably a silly concern cuz I want everything to be "perfect". Thanks for your help!!

If you're over the poverty line, then you'll be accepted at NVC. You might just be questioned about it at the consulate/embassy, depending on how "strict" the beneficiary's country is. They might not care, who knows. My husband started a new job a little less than a year from when I interviewed (he got a new job in June, I interviewed the following May). No questions about it at all. But, I went through Montreal, Canada, one of the easiest consulates, so.

I think it would be a good idea to include the W2s from your new job. I would, if I were you - whether it is necessary or not. You can never be too cautious and your concerns are legitimate.

I realize that it shouldn't hurt to send it especially since I have it readily available. I'm just afraid of giving the NVC an excuse to get off course since it wasn't in any part of the instructions (probably a silly concern). Thanks for your response though!

pay stubs are a better way to show your current income than a W2 unless the W2 actually has over the poverty guidelines. But pay stubs and/or a letter from your employer will be better at proving current income.
