Many people on this forum lived very similar situations and already shared it on the site, just go back and read the threads: Vawa, Vawa 2, Vawa 3, Vawa 4, and this one is Vawa 5. There are hundreds of pages for you to read and you will see that many people lived mental and physical abuse.

If your Lawyer filed your Vawa properly and proved Bonafide marriage (including proof that you lived with your abuser), Proof of Physical or Mental abuse and Proof of good moral character, you shouldn't have a problem getting you Vawa petition approved.

Since you sent your Vawa application already, the only advice I can give to you, is to stay away from your abuser and wait for the decision. The Vermont service center(the office that takes care of Vawa petitions) have been fairly quick with recent applications. My Vawa application was approved in 3 months.

I submit it on April 5 later on they request more evidence like my police clearance . I do know if its a problem because you said i have stay away from her . my wife want to come back together and we start dating for some days and also we went a therapist for family suddenly she disappear she changed her phone num and bloked me on face book

Hello guys.

Good afternoon.

I just checked my visa status on the uscis site and it says request for further evidence.

I actually haven't seen what they want more from me but I am so nervous. I am panicking right now. I don't think I have more evidence to show them

Im so scared. What if they deny my VAWA? oh my god..im so scared. I checked my mail and the actual paperwork is not there yet. It says they mailed it on the 24th

How long do I have to respond to the RFE?

How long does it take for them to respond?

What if I cant possibly give them anymore than what they are asking?

Is this the end of the road for me?

Im so crying right now....

Wildwoodflower21 don't worry about it, I had 3 RFE. And you have plenty of time to respond I think 60 days or something. I freaked out every time too, and thought there was nothing more I could send, but you deep dig and find more stuff that might help.

I just had my AOS interview yesterday, I submitted my VAWA application in November of 2010, got PF right away and then 3 RFE (few months apart) and got approved June 26 2013. Then filled my AOS in January 2014 I believe and had interview July 28th, now waiting.

So sometimes it takes really long for VAWA to be approved. What all have you sent with your VAWA package, like what supporting docs?

I am thinking that there could be a lot that my VAWA is missing.

First of all, I left our house without taking much with me. My husband was very controlling. I didn't know anything as far as the house bills and all of that is concerned.

I didn't even know who was our internet provider or whatsoever. He would shut off my phone if he suspects of something or if he feels like it. I didn't get out of the house much at all. Didn't get to meet any friends of his or even neighbors. I was warned I should never get out without him. So, it could be that good faith in marriage, or evidence of abuse.

I never called the police because I was so scared at that time and he always scared me that if I did that would jeopardize his job and he would loose his job because of me. I had pictures of my face punched in my left eye. Nasty emails he sent to me, threatening me and admitting that he posted personal photographs of me online that triggered me to totally disconnect with my friends and most of my family back home.

I am very scared and hopreless ...It could be anything and everything that they want.

Was your name on anything? Rent, any bills, cellphone (even as secondary account). Did you receive any mail to that address? Can you go back to the house and get your stuff? If it is your things that you left you can be escorted by police to the house. How recent was the abuse? I know you said he disconnected you from your friends and family by sending personal photos and etc. This could be time to explain to your friends or family what he put you through and that it wasn't your fault. They can write an affidavit that they have received personal pics of you.

In my case I was able to kick him out of my apartment after telling his family of things he did and I moved shortly after. And I burned bags of things that would remind me of him, I wanted to wipe him out of my life and I was very sorry when I was filling VAWA since I had such hard time finding things for proof. Also aftre you left him where did you go? Where are you staying, would ppl there be able to help you. When it comes down to it you can be honest and just explain your situation in letter and send it with your RFE.

I mentioned that he took me to his "tax guy" office and they talked and he introduced me to him as his wife. He told me then that he is claiming me in his taxes. I don't really understand anything about that.

I also sent them a copy of a medical insurance letter addressed in my married name and our address.

Other than that, not much more that I can think of.

I left our house just last year 2013 so the abuse is just fresh and within the time frame.

I literally walked out of our house with just clothes on my back. I didn't even know that VAWA existed til a girl friend from the same country took me in and helped me. I thought for sure I would just go back to my country. But then when he started spreading personal pics of me to just about everybody I know or even barely know back home, I coulnt face them. My own father doesn't speak to me anymore because of the humiliation and divorce threats.

Anyway, I called a friend of mine and told me not to panic because I don't even know what they want from me yet. Its just easier said than done tho

Oh God, please help me and everyone here...I feel so distraught and hopeless.

hi first of all a big congratulation for your patience for the 4 years please if you can look up to my situation i never tell my story beside my lawyer so i need somebody can advise me if you don't mind

I came to USA like a student and during the attend to school i met my citizen wife we loved each other after a long dating we decide to get married with her so we had a big wedding and my family came from my country to assist to my wedding and we have a nice honey moon to Cancun., after we came back from it the problems start . first of all she always threaten me for everything she told me if she didnt get pregnant she will not go with me to the migration interview and also she make me work illegally in 2 restaurant and she always asking about money . it s not even that she tried to convince me to work with her cousin social security i refused to do it and she start humiliate me that im not a man enough and that i am handicap when i forget to close the drawer in the kitchen and also she never cook for us . I always cook and make her luch at 5am so she can take it with her to school because she a teacher . on day she told me i want you to give me 5000 so i can go with you i told her i didnt get married with you to make business . the next day she told me that she change her mind and asking about 10 000 to go with me to the interview when i refused because the purpose me getting married with her is for love and for life .the next day when i refused she came at home with her mom and called the police on me so they can kick me out .before the police come in she hit me with the vase in front of my friend .for all those 6 month together it was fighting and humiliation and threatening . maybe i couldnt find the words to explain the situation right but all this time i was scared from her and also she make me quit school because she said you dont have togo and those money for tuition we can live with it . after she left my friend and my sister took care of me and helped me to step on my feet financially and psychologically. I went to a lawyer we fill up the VAWA petition in the folder we sent

Members I have a question to ask.

Do the insurance companies like Metroplus, Healthfirst (these are based in NY not sure about any other state) know when your immigration status has changed?

Got the weirdest phone call today requesting to update my sons coverage to include medicaid because there has been a change in his immigration status ( im currently waiting on a decision after my interview 7/24).

wilfflowwer r21 you have no idea the number of people that asked my help after receiving RFE,some USCIS asked evidence of bonafide marriage,others to prove abuse and MANY to prove both.I was able to explain well and all cases were approved.It's not the end of the road at all.Wait for the RFE,you will have 87days to answer and DO NOT rush to answer,take your time and gather what they are asking or explain why you don't have what they are asking ok.I answered an RFE three months ago and he alien was married 06 days, and after the RFE answer he was approved.Show to your lawyer and do not get desperate ok.

flexx who told you that you will get "an answer" from immigration next month? A Vawa case may take 2/7 months to be adjudicated.Nobody can tell you when your case will be adjudicated.

What's the reasons stated in the police report? if you were not battered, and the cops just showed up in your house, because of verbal altercation then this is not ground to have a Vawa approved.If mentioned mental abuse then you need to provide a psychological evaluation.Read all Vawa thread, and you will find a lot of information
