USC husband changes his mind

I am almost on my final step on this visa journey. My interview is next month already and now my husband changes his mind and doesn't want me and our 1 year old son to go to the US because of a very shallow reason. My question is.. Is my case hopeless? does really my visa depend on my husband's decision? The original paperworks is still with him and he is supposed to give me those when he comes back in th philippines this march. What should I do now? I really want to go the US to meet his family because it is so unfair on my part that he can go here anytime he wants but Me and our son doesn't have that priviledge. anyone advise?

If your husband no longer supports your visa, then you can't do much about it. You should be talking to him. When is your interview? I assume it is after March, as you were relying on his visit.

3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

According to your timeline you have p4 which is the interview date. Anything sent to the NVC will go to the embassy so I'm unsure what you need from your husband. However, I do think you guys need to have some serious conversations about why he doesn't want his family with him in the USA. You don't sound like this is an okay decision with you, so stand up for yourself.

That's a strange decision for him to make :-(

You are not going to be able to do anything about it except talk to him and try to get him to change his mind. If he doesn't want you to live in the US with him then what does he want?

He doesn't want his child to be able to live with him? I can understand that he may no longer want you in his life. I don't mean that In nasty way but we all know couples break up all the time. But his child? If this is his attitude towards his child, do you see a future with him anyway? Is he the kind of man you want?

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

This man seemingly wants nothing to do with his own child. I know a couple of kids here in the UK whose dad also wants nothing to do with them, and it has caused them all sorts of emotional damage, since they grew up with him for a few years to begin with, then... he just left, stopped all contact and refused to even acknowledge them. It's really sad.

OP, if I were you, I would have nothing further to do with this person who does not acknowledge his own child and find someone else in the world who will step up to the plate and be a man for both of you. You and your son deserve MUCH better than this flakey has-been.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

since you had a case complete at NVC on 2013-12-27

these 'original documents ' you speak of were :

1. already submitted to NVC and

2. NVC put them in the casefile and

3. That casefile is either IN Manila IV already or headed that way.

So, this concept of 'original documents in his hand', I suggest to you, is a fallacy. Perhaps he's lying to you about this, to use as leverage against you.

But that's really a side issue. If he doesn't want you and his child, that's on you and him to work out. IMO, you could get the medical done, go to the interview , get the Phils interview thingie, all without his intervention.

Then what?

slowlyman - great advice for a K-1, but the OP is chasing a CR-1/IR-1 visa, so 'what to do in USA' is totally different than a K-1 visa chaser/holder.

I'm so sorry that your relationship is on a bumpy road right now. But what you should really do for your own good and your child's good is to stay in the Philippines. This petitioner seems so irresponsible to do that to you and HIS child. Imagine a future with him. Lets say he change his mind and would allow you and the child to come over in the USA and then a month or so you will have a misunderstanding with you and then he would do the same crazy BS. You will be left behind with nothing.
