First, goto the CBP website to see if your I-94 is there and correct. IF it is, print out a couple of copies. If not, see why it is not coming up--you may need to go to a CBP inspection station to get your information corrected. Goto the SSA and apply for you SSC. Make certain you do this before the 74 day of having entered the country (2 weeks remaining on your I-94) as the SSA will not process your application as a K-1 if the I-94 is about to expire--you will have to wait for your employment authorization (EAD) or GC. Take along your passport with the K-1 visa, I-94, and another document showing DOB or identity (some require this and some do not) and a completed SS-5 form (some will take this and others will enter the information as they ask you questions). It is best to apply in the name that is on the visa as doing otherwise has caused problems due to the lack of training by the SSA employees.

Good luck,

Dave

Take your I-94, passport and marriage certificate (I had additional papers like birth certificate, noa2 from k1, etc with me but didn't need anything else) then google your closest social security office, go there, fill out the power work and you're done.

But important is that you have time left on your I-94. If it is close to expire they'll make you wait till you have your EAD at least or your greencard if you dint plan on applying for work permission.

Good luck

(I got my ssn in my married name one week after I was at the office. I also would recommend printing out the paperwork online and fill it out beforehand. Google 'form application ssn' this will save you lots of time at your office since you can straight get a number and get in line and jump ahead of the hundreds of people that come unprepared ;))

Hello!

I was in the SS office and gave them my passport with k1 visa under my maiden name, my 1-94, my marriage certificate and the SS form but I already used my married name. They asked me to have my k1 visa name changed into my married name first before I can apply.

I dont know if that's possible, or is it better if I just fill out the SS form again under my maiden name the same as the name in my k1 visa and declare single though im already married?

Thanks!

Yet another SSA worker that has no clue about how things work for their own jobs. No, you cannot change the name on the K-1. The K-1 visa became null and void once you used it to enter. Getting married does not change your eligibility to get an SSN if you have at least 2 weeks left on your I-94.

Try it in your maiden name. No need to lie about being single. The form to apply for an SSN does not even ask about your marital status.

Once you get your EAD/AP or green card in your married name, then go back to the SSA to change the name on your SS card.

That shouldn't be necessary. Go there again, if the clerk wants to tell you again that it's not possible, ask politely to talk to a supervisor. Obviously it is possible (I'm not the only one this worked for) and sadly it seems like people at the ssa are poorly trained and don't know what to do when it comes to k1's.. If the supervisor also insists on not being able to do it, get the social security card with your maiden name but DO NOT claim single. You're married so staring you're single would be lying. You can just get it with your maiden name and get the name changed once you get your ead or green card.

I hope next time you'll get somebody that knows what they are doing!

Same situation here....These ppl have no clue what they're doing. I just applied for ssn today wanting to use my husband's last name and she wouldn't let me. So I agreed to put my maiden name on and change it once AOS is approved, but it's just ridiculous. Not to mention how unfriendly the lady was. So, I got home and called the office to make sure, if I can use my husband's last name with presenting marriage certificate or not and the lady on the phone said yes! Then I told her what happened in the office and she got mad at me for calling and asking them that stuff, if I already been there and got my answer, which she said it's the right one cuz they know more!!! Really??!!! I'm so pissed today lol
