confusing letter from embassy?

Received a letter dated 27th of December today (guess it was delayed by Christmas :P) which says the following:

We refer to or communication concerning the receipt of an approved petition according you status as a fiancé(e) of a United States citizen.

As of this date we have had no reply from you. Please inform us within sixty days whether you intend to proceed with an application for a non-immigrant visa to marry and reside in the United States. We would appreciate a response even if you wish to abandon the application.

Is this normal procedure? They only received my case like a week ago, I've had no other letters from them except for this. My CEAC status says 'Ready'. To me it feels as if it is a letter wondering why I haven't done anything yet, as if i've taken a long time or something like that? xD

I booked my medical for Jan 15th, is this too far away? I haven't filled out any of the forms yet, since it was Christmas and such. Is that perhaps why they sent me this letter? And am I correct in thinking all of the things leading up to the interview are submitted online now, and i should have two forms to fill out - DS-160 and the readiness form?

Sorry for so many questions. This letter just left me pretty confused xD I was all excited thinking it was going to be my instructions and such, even though I know where to find them. :P

I thi k you happened to get issued the wrong letter. Gremlins in the mail room? Consider it your "packet 3" letter and carry on. You don't have to move your medical. Yes to DS-160 and Readiness. Two forms. Both online. All documents go to the interview with you. It sounds like you know the process and London is the confused one. That letter goes out when they have heard nothing from somebody for about 6 months to say "last call".

Thank you SO much I was really puzzled when I opened it xD. Thankfully I recieved the NOA2 in the mail and addafit of support and an updated letter of intent from my fiancé in the mail today. (I know the updated letter of intent is usually if it's been a long time between NOA2 and interview but I thought it couldn't hurt to have one! :P)

I think I am probably ready with documents now? Like I have my police certificate, long form birth certificate, passport in good condition, the two US sized photos and one UK for the medical. A lot of the things on the list the embassy gives doesn't apply to us (no prior marriages etc)

I have two I-134s, one from my fiancé, one from fiancé's mom. Heres the evidence I have got, since you told me that London wants one proof of income but take two just in case :P

Fiancé

-I-134 which is over 100% poverty level but under 125%

-print out of online page with his employment details, like his hours, stating his full time, a contact number for manager (he works from home for a company based in Texas)

-print out of paystubs from employer website where he views them online (no paper ones issued)

-print outs of online bank statements showing deposits

Fiances mum

-I-134 stating her and my fiances stepdad make over the 125%

-2012 tax return

-certificate showing when the buisness was registered

^is this sufficient for a co sponsor? I figure that the certificate of when the buisness would register would work in place of an employer letter kinda? It has my fiancé's parents' name as the owners so I thought maybe the officer would look at the tax return to see how much they made and then the certificate and be satisfied with that but I'm not certain? XD

and my other question: going to fill out DS-160 tonight, but readiness form before or after medical?

Regarding your Fiance's one - London are generally alright if it's between 100-125%. They may give you a verbal smack on the wrist to say "You need to have this sorted before you adjust status". The evidence is all good.

As for his Mum/Stepdad, that's also fine by the looks of it and if they say the one from your Fiance isn't good enough.

As for the Readiness form, I personally did mine the same day I submitted my DS-160 because I had my medical booked and I had no intention of moving that date come hell or high water.

Everything thing Wheatley says, I agree with. Try turning in fiance's I-134 alone with the document collector person. Have the other in case the interviewer insists it isn't enough for him.

Self employed is a little trickier. Some who own businesses take many business deductions to reduce their taxable income. Line 22 of their tax form 1040 is what the government looks at to determine income, so make sure that line qualifies. Revisit the topic of everybody's income when you file for AOS (form I-864). The proof will be slightly different for that form.

Regarding your Fiance's one - London are generally alright if it's between 100-125%. They may give you a verbal smack on the wrist to say "You need to have this sorted before you adjust status". The evidence is all good.

Thank you! My plan was to show my fiancé's addafit and documents, and then if they said it wasn't good enough, pull out the one his mom sent :)

Just filled out DS-160, that felt like it took forever!! So am I correct in thinking I pay the fee once the interview has been scheduled? Or can I pay it now, or will they ask me for it? :P

I think I'd rather pay it now if possible, so I feel confident everything is done!

Pay the fee after have know your interview date. I think the latest version of fee and courier scheduling asks the date of the Interview. I've kinda lost track of the various versions they have gone through in the last six months. Somebody who paid recently will hopefully chime in.

Just checking back to say thanks again both of you :) London confirmed it was an error via email :P

So completed DS-160, picking up proof of my vaccinations tomorrow and making an appointment with my GP to make sure I don't need any extra things to take with me to my medical. I think the only vaccination I might need is the one for the flu since it's winter. Then I should be sorted!

The letter is a mistake. They generated the wrong letter. That letter arrives if London has your case for many months and nothing from you. It's their way of saying "hey--do you want a visa or not? Hurry up and apply". It was issued by mistake instead of your instruction letter.

You just need to complete your application forms as explained in the pinned London K1 thread. The letter you were supposed to get is discussed in post 2, item 3. You don't have to have the paper letter for anything.

It did scare me though! I was like whaaat do they think I'm giving up or something? Haha! Yeah it's an error :)

Off topic sorta but I have got my medical on Wednesday! Already sent the readiness form so let's hope London is quick giving out interview dates :P

I got a response from the Embassy and it was very good actually, helpful which is the complete opposite of the last one...

"Thank you for your inquiry.

The letter to which you refer was sent in error.

We are pleased to inform you that the Immigrant Visa Unit has received an approved petition in support of your fiancé visa application. The next step in the process requires you to complete additional forms and collect applicable documents. Please refer to the Immigrant/Fiancé(e) Visa Interview Checklist, available at http://london.usembassy.gov/iv_15.html, for detailed instructions.

The K1 petition is valid for four months from the priority date (listed at the bottom of this letter). If your interview will occur after your priority date, your fiancée must submit a statement of intent to marry within 90 days of your arrival in the U.S., in order to revalidate the petition. Photocopies will not be accepted.

Information regarding registering for the courier service will be included with your appointment confirmation letter.

The Issuance of a K visa is not guaranteed. A Consular Officer will evaluate your case and make a final determination. You are advised not to make any travel plans until you receive your visa.

Should you need to communicate with the Embassy regarding your case, please provide your case number exactly as it is listed below.

Good luck with it all! I'm sure it will go great! And keep us posted on how long it takes to get the interview! My fiance's medical is in the next couple weeks as well so I'm really curious how long it'll take us to get to the interview.
