Greetings,

I’m looking for a friendly peace of an advise from you pals, I’m determined to sponsor my spouse as I’d been waiting for years & years to become USC since I’m too close to that, should I go ahead file an I-130 based on LPR and in like couple of months I’d get the get category change from LPR to USC … so this way I’d have her priority date preserved and save our couple of months... what do you say ?

Your feedback will be truly appreciated.

Timeline

Just had my interview at Orlando. Interview at 8.00 am. Reached 7.55 am. Went through security and got finger printed, photo taken and waited. Got called at 8.10 am. Done with the interview in 15 min.

Nice lady at the interview. Verified the info on the application. Since I moved last month got the new address in the system

Asked me to swear an oath

Give me the 6 q's. Age to vote, bill of rights, ocean on the west coast, why there are 13 stripes on the flag, what is the rule of law, what happened on 9/11

Then oral and written test. It was over.

She congratulated me gave me the approval generic letter and asked for me to wait for the oath ceremony.

Then I got out and came to job.

In all pleasant experience so now the wait for oath starts which can be a month or two in Orlando.

I just got back from my interview. Wow I don't think I waited even 10 minutes. They called me right away!! The lady that interviewed me was nice and we went straight to the questions after she looked at my ID and green card. After that she had me read out loud "How many senators are there?" and then I had to write down "There are 100 senators".

I'm trying to remember the 6 questions she asked me but I can't remember them all. I know she asked:

1. What is the name of the national anthem? - Star spangled banner

2. What is the rule of law? - Everybody must follow the law

3. What ocean is on the west coast? - Pacific

4. How old do you have to be to vote? - 18

5. Why are there 13 stripes on the flag? - 13 original colonies

I'm missing one that I can't remember right now.

We went through my file and she checked everything. I had brought a copy of our new lease (actually the original) and she made a copy of that. She also made a copy of my passport, I know I had sent it before but they must have lost it.

The only thing I'm worried about is one thing the examiner did. My Nicaraguan passport has my full name, the thing is that according to Nicaraguan (and majority of Latino countries) law or customs the married name of a woman has "de" in the middle. So let's say you're Sofia Perez and you marry John Smith, you then become Sofia Perez de Smith. So that's what my passport says. However, when I came to the U.S. my green card was issued following the American way, so it says Sofia Smith. Now the examiner said that my file still shows my name the Nicaraguan way, so she filled out a court order to change my name to just Sofia Smith... even though my Green Card and ID already show it as Sofia Smith.

I don't know if that's going to delay anything, but at least the hard part is over. I asked if the oath would be at the same office and she said I have to go to hall because of my name change....she said I'd have to wait between 2-4 weeks.

Your case sounds similar to mine. I think they will ask which name do you want and if you want to drop your mom's name then maybe they will fill out the court order name change. I am honestly not sure if that is something you can do before. I didn't anticipate it being a problem since my ID and Green Card have my married name only but I told her I wanted the shorter version.

4. What is freedon of religion

5. Who is my Congresswoman

6. What is the Capital of the US

We then went through the info on the application. She asked questions about all the international travel I had done as part of my work, and then she approved.

Whole thing didn't take more than 15 minutes. I asked for name change in order to correct misspelling in my paperwork. She mentioned I'd get a letter with an Oath date in around 2 weeks, with the ceremony in about 3-4 weeks.

The question listed on the USCIS website is: "Name your U.S. Representative". If that person is male, then he is a Congressman. If that person is female, then he is a Congressman. http://www.uscis.gov/sites/default/files/USCIS/Office%20of%20Citizenship/Citizenship%20Resource%20Center%20Site/Publications/100q.pdf

For example, Congresswoman Sheila Jackson Lee represents parts of Houston and Congressman Michael Capuano represents parts of Boston.
