File K3 during i-130 process:

Good afternoon all,

I think it might be worth it to file for K-3 visa at this point and time, I sent out my petition during July. I contacted a person in the liaison department and he said I still have at least 6 months of waiting.

From other ppl in VJ, they said the wait time should be around 11 to 17 months. I just hope the request doesn't land itself to overland park. Any suggestions? I understand K-3 is obsolete, but it might bring my wife and I together quicker.......

IMO, currently, filing an I-129F SEEMS to get the I-130 yanked to another office altogether,

and both are adjudicated at the same time.

IMO, if it seems useful, this casefile pulling, then I say go for it. Ya, I usually don't say this, but if yer gonna wait regardless, a casefile yank seems useful.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Thank you for the response Darnell, just wondering where did you found out an i129f would get i130 yanked? And do you know which office it is yanked to?

IMO, currently, filing an I-129F SEEMS to get the I-130 yanked to another office altogether,

and both are adjudicated at the same time.

IMO, if it seems useful, this casefile pulling, then I say go for it. Ya, I usually don't say this, but if yer gonna wait regardless, a casefile yank seems useful.

I'll keep you guys posted.

What i have read from others is since you do have a I-130 on file the I-129F will be sent also to NBC (I had thought it was going to TSC with the other I-129F) but nope.They will marry up your two petitions so they can sit and marinate together. but hey like darnell said if you are waiting all this time why not. lets hear a successful story about a k3. Would you guys think it's pointless to send in the I-129F until you've waited at least 6 months or so for the I-130? Kind of a watch and wait stance, if that makes sense.

Nah - I say send it off when you have the NOA-1 on the I-130 in hand, not to wait 6 months.

Why? Please note that the 'current routing' of stuff is some big problem, and filing an I-129F ( IMO ) actually does something else with the I-130.

But that's just my opinion. With it, and 200 g of fibre-plus cereal, you can have a nice carb-filled morning.

What do you mean by the current routing of stuff? Are you saying the I-129F has the effect of sending the I-130 somewhere else and making it get processed faster? I thought they both are met up with each other at the NBC and then the I-129F eventually gets cancelled out.

What I don't understand, what it will help filing a I-129, since you already filed for an I-130? If I read the info from state.gov correctly, then it will help nothing?

If the NVC receives the I-130 before your I-129F:

  • The NVC will administratively close your I-129F
  • Your spouse cannot receive a K3 visa
  • The NVC will contact you with instructions on how to process the I-130 petition to receive an IR1 or CR1 immigrant visa
