Am I waiting too long for the GC Interview?

 Share

Background: Got married on June 26th, application package sent out on July 1th (Day one)

Receipt received on July 12th (Day 12)

Finger print collection Aug 6th (Day 36)

Received EAD on Sept 9th (Day 70)

And have not heard anything about my interview...

Is this a normal amount of time for scheduling interview?

P.S. my case is in National benefit center, and I am located in ATL,GA

I contacted local congressman and on my behalf, they got the advice from the Immigration office: the current time length to process this type of case in ATL office is 5.5 month.. does this mean my case has been sent to ATL local office?

Not everyone adjusting from a K-1 has an interview. The cases being approved without interview are taking a long time to process. You can check other posts on this topic in the AOS Progress Reports sub-forum.

~ Moved from AOS from Family Based to AOS from Family Based Progress Reports- topic is case status/wait times ~

Day 1 starts with the date on the NOA1, not the date you sent it. But no, you are not waiting too long. If you local office says 5.5 months, then expect an interview letter at around 4.5 months, which is at least one more month from now.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

My husband is in the military and he will be going to a 6 month deployment starting the coming up Jan 31th..I am concerned about the date since I read on the forum that rescheduling the interview date might cause denial. If the interview date is actually after his departure date, should I reschedule? Or is there a way to expedite on it?

Thank you for yall help!

As Harpa said, some local offices have longer backlogs than others. It sounds like Atlanta has a heavy workload right now, hence the reason for your wait.

The NBC does the initial processing in a family-based AoS case, but they dispatch the file to the beneficiary's local office for the interview and final adjudication.

With regards to your husband's potential deployment, if he is unable to attend the interview due to being abroad on US government service (such as the military) then this will not be penalised; you should bring a copy of your husband's orders (or other official documentation indicating he is abroad on government service) to present to the adjudicator if your interview happens to fall within the window of your husband's active tour. It would not be a problem.

Thank you for your comment! Yes it does seem that ATL has a huge work load right now.. and hopefully it will not come to the case that I have to attend the interview by myself

What do you mean by 4,8 month? and also are you saying I should contact the congressman again or ATL local office? I m not sure if I can just walk-in the local office and ask about it.. and what do you mean by over limits?

Thank you
