Hi all!

Forgive me if there is already a thread on this topic but my question is:

My fiancé in Cambodia got approved for a K-1 Fiance Visa to marry me in the US, can I legally marry him in Cambodia first and then fly back to the US to marry again?

Since I will be in Cambodia already for a visit, I would like to celebrate with his side of the family in Cambodia first and then with my side of the family in the USA. I was hoping to visit during the same time that he will be leaving to the US, so that way after our Cambodian marriage, we can fly back to the US together. Is this possible or am I breaking a law since his Visa is for marriage in the US? Any advice is greatly appreciated. Thanks in advance.

I'm sorry, you can't do that. You have to get married here in the US first because he will be entering with a K1 (fiance). If you marry him first in Cambodia before he comes to the US, then he would no longer be a fiance but a spouse.

No, if you have an approved K-1 visa, the fiancé must first marry the fiancée in the USA within 90 days of USA arrival. You can go back to your home country and have a ceremony afterwards.

No, no and NO! If you marry in Cambodia then you are MARRIED not engaged... You can't get second married since the Cambodian marriage will be legally recognized... You would have to start over from scratch filing for a spouse visa... Must get married FIRST in USA... Then travel later to celebrate!

Be careful with this advice... There are several threads dealing with people denied because they, uscis, considered them married even though it was just a "ceremony" and not "legal" and thus not eligible for K1... If it walks like a duck!
