Unfortunately I don't think that is the way it works. Waiting for AOS for a year adds another year to our journey, they take our residency from our conditional GC, not from the date we got married! I hope someone tells me I am wrong!

I think you may have misunderstood me. I was talking about ROC. It takes it from the date of the first GC, so even if ROC takes over a year you should be able to file 3 years (minus 90 days) of the date your permanent residency started which is detailed on your Conditional GC.

I think that you've got to be a permanent resident for 3 years AND still married to the same US citizen.

That is/was my problem. I booked this trip in May, thinking a year was plenty of time for a GC (rolls eyes).

Feb 23rd-27th I'm out of town, receive two NOA (EAD/AP), and a Vaccination request.

Feb 28th-Mar6th I'm in town, complete vaccinations, receive Biometrics for Mar 11th, and send both vaccinations and Bio reschedule.

Mar7th-21st I'm overseas, GC approved, produce and sent, but apparently zero physical correspondence.

For the previous 10 months I never left Los Angeles. Clearly the answer is to offer the temptation to the USCIS of not being there to collect your mail...

We booked our trip overseas to coincide with our year anniversary. IF it takes a year, then we'll be in Europe when his GC is approved. smh

I still have a SR that I filed on Feb 25th that says "assigned on March 9th" on the left and "unassigned on March 9th" oh the right. What the heck does that mean. Is it assigned to an officer or not?? Its the same exact SR number. It told me when I field it that I would be a response by March 19th. Hum, thats tomorrow lol

I think they confused themselves. If tomorrow, it is the same, send the new request. My request was unassigned since Jan. Once I put the new request in Mar, they assigned the previous one immediately.....

I know that I may get nothing update for my case relying on the respond mail. But, I have no other option. All done.......checking USCIS website everyday, calling USCIS, sending SR, contact senator and ombudsman for yesterday.....almost a year anniversary since filing in next 2 weeks!!!

Yes if they dont issue the GC before the 2 years is up then you get a 10 year GC, which probably happened in the case of the person who received the 10 year card. The only thing I didn't get about it was they had no interview to show they had been living together for 2 years, unless of course they sent a lot of evidence for AOS. They got lucky I guess and I am now wondering if they can apply for naturalisation?

Wow, you guys are really interested in my case!

To answer some questions, I arrived in Jan 2013 on a K-1 visa, married in March 2013. So yes, by the time they finished my case, I had been here 2 years of time (I believe 2 year vs 10 year is based on arrival date, not marriage date, but that's just something I remember reading awhile ago, I never thought it would apply to me!). I guess the unfortunate delay with the filling of my AOS did have an unexpected advantage in the end!

I'll keep you guys update when the card arrives, if it is in-fact a 10 year card, or if it's a 2 year card, but all I can tell you is that the letter does state a 10 year card, so I presume it will be that, but I'm just happy to get my greencard no matter how long it is for. I wouldn't recommend anyone planning to wait 2 years on purpose though, it meant I was not able to reliably safely travel back to England, meaning I missed some important family events, and it would never guarantee a 10 year card or no interview, I think I just got rather lucky, my face must look very trustworthy and non threatening! Hahaha.

03/09: Registered permanent status and mailed Welcome notice
03/11: Ordered new card to be produced
03/18: Mailed your new card

03/18+6ish hrs: USPS collected your new card

USPS also gave me a tracking number. So far my card was produced in Kentucky (I think we already knew that), and has made it to Tennessee. The race is on - who will make it back to LA first?
