Hello,
My wife have been trying to file in for me for a family immigrant visa (IR-1,CR-1 spouse visa), we got married last year and ever since we got married i have asked her to stay with me in Nigeria she is yet to go back.....but now we have both decided to move together to the US but i have a previous issue with the US embassy in my country here in Nigeria i won an American lottery for immigrant visa in 2010 which i was married to another person and we got the interview and after the interview i was ask to come the next week to collect our visa 3 days to the collection day i was called to come over to the embassy to identify something the consular ask if i have ever applied to the us embassy before but i said no the consular then printed a copy of the picture that looks exactly like me out but i denied that should have been my cousin but i was later asked to bring my cousin but i took along with me some couples of pictures indicating that was not me but the consular refused my visa because i couldn't provide a solid evidence to it, i later filed a case with a lawyer claiming that was not me but the duration of time and date given for the lottery was over so i didn't hear back from them. please the help i need right now is that i want to know what i should do because i was afraid of losing the visa then that was why i lied, it was my travel agent that arranged to get a visa for me then in 2002 but i didn't get the visa then and it was with a different name,date of birth all the info on the passport was different i didn't do any finger print then is just the picture that is the same with my real passport now and i got divorced after then in 2011 because my previous wife didn't love me like i do she as been a cheater, i later meet with my new wife in December 2011 and we got married in 2012 please how do we go about it without losing the immigrant visa again now because my wife want me to stay together with her in US.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

so, with original misrepresentation back from 2002, you are hoping for some path leading to a green card?

I'm unsure if that's possible for you, as :

1. you lied on the first attempt and

2. you lied on the 2nd attempt

Perhaps someone else here will have other inputs for you.

Actually you can get a waiver on a misrep ban. I doubt it will be approved however.

I read somewhere someone from Algeria had

misrep & request of asylum denied; It cost

lots of money and years,took it to the Supreme

court ,waiver granted years later due to that

solid hardship , their child had Brain Cancer

so this is a uphill climb for you and new wife.

Well there's misrep and there's fraud. This is blatant fraud. Coming under an assumed name. What if this was a terrorist trying to get in on someone else papers.

This is the reason why Nigeria is Fraud capital. They are Kings in the creating false papers. I don't see how you can get a waiver for totally being fraudulent.

A bit different then saying you were 35 instead of really 28. Or you lived in Enugu instead of Lagos. Or even submitted false banking papers making it look like you had money or saying you had wife and kids to look like you have ties. All things I know people have done and got through.

But to totally submit a false identity. Yikes. Just saying. This is why the road is so hard through Nigeria. So sad.protest6wz.gif

However, that being said, waivers are approved based on nature of the misrepresentation and proof of extreme hardship on the U.S. petitioner. I agree that the nature of this crime is pretty heinous, and therefore, while a waiver can be filed, it is unlikely to be approved.

You think you can tell one story and then another to the embassy and they will forget it. They have your fingerprint and they know that the same person has been trying to get by with more than one name and passport. I know another man that tried this and they brought up the tourist visa he applied for year before with different ID and he was denied. Did you hide you previous marriage this time ? The US does not care much for liars and it not apt to grant a waiver. If your wife has demonstrated that she can live for extended times in Nigeria it is highly unlikely any waiver will be approved no matter how much money you spend on lawyers

Exactly, I agree with the above poster.

Looks like your wife will have to live there.

99 % chance the waiver will not be approved unless she (not you) can

proof that she has extreme hardship living in the US without you. A waiver is a very difficult undertaking. It is not just a form to fill out.

She would have to assemble an extensive hardship letter many pages long proving several hardship points with attached strong evidence.

Lawyers charge a median fee of $4000 and up for this and you need guidance from a lawyer who is knowledgeable with waivers for misrepresentation. To save money here with just any lawyer would be a huge mistake and you might as well flush the money down the toilet.

The waiver is given or not given upon discretion of the CO and then it can take 9-12 months to get approved or denied.

It is the one and only chance you have as you are banned for life with misrepresentation/fraud.

Lying and fraud comes with severe consequences in regards to immigration and life in general.

On top of the fraudulent passport you tried to sneak by with, this is your 3. attempt to get to the USA.

Recently divorced in 2011 and meeting your current wife that same year and marrying in 2012 are all red flags.

The CO's impression with all this will be that you are using your current wife as a means to immigrate.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

shocked.gif Really shocked, u just always try to just get entry to USA with mis representation, still u r making stories but i bet still u r hiding that ur cousin looks like u n u hired lawyer n all that n now u r putting Question here, what i can tell u here is TRUTH ALWAYS WINS NO MATTER WHAT.....we all know USCIS & Embassy take their time to give us approval but iam sure they have very excellent process for us to go through, so never lie in ur life again. if u really love ur USC wife ask her to live with you in ur country believe me true love does not see where u r living either in USA or Nigeria...idea9dv.gif

Buddy, I don't mean to be mean but if I was the officer and I know you lied to me like that I would ban you twice for life. I wouldn't give you a second chance at all. I mean do you think that the US doesn't know anything about you? I bet you just by the background check they know more then you know about yourself. And you tell them that you have a cousin that looks like you? I bet you they know that cousin doesn't exist. Honestly all I see here in your path to the US is a big rocks that prevent you from coming to the US and moving those rocks or clearing your way is going to be almost impossible. This is what will happen if you go again. USCIS will know from the embassy data that you lied to them before so you are a fraud to them. The officer will just listen to you and ask you questions and then they will tell you you are denied. Lawyer you will need a goooooooooooooooood lawyer and biiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiigg bucks to fix your situation that if it's fixable (I doubt that). Honestly I think you should let your wife know about your situation from A to Z and let her decide if she wants to be with you or not and if she doesn't I think it's fair for her to let her go and have her own life. You destroyed your life by lieing, If you were honest from the first second you would've been probably living already here in the US. I'm sorry for all these words but I'm trying to make you understand you ADDED your name (

by yourself) to the black list in the US.

A waiver won't work either. Good luck.

Not directed to the OP per see but I'm starting to see why the ConOff stated that they don't give as much credence to all the paperwork evidence as much as the actual interview. And that Nigerians can come up with fantastic documentation which is all fraudulent even including elaborate wedding pictures.

PS: One good thing though is that the Nigerian economy is improving in leaps and bound and many in diaspora are returning home.
