I130 and I129F applications get joined.... how exactly??

I've been reading the forums, and I gather there is a slowdown in I130 processing, with things hopefully picking up when Overland Park starts processing this September.

Question: Our I130 was received on May 12, address given was Overland Park (NBC). We then applied for a K3 Visa, because we want to move to the USA ASAP and want to cover all possible bases to do that (even though K3 is supposed to be obsolete). The I129f was received on June 3, address given was Lee's Summit (NBC).

From reading the forums, I have read that the I129f will be sent to join the I130, wherever the I130 is. I have also read that the I130 will be sent to join the I129f, wherever the I129f is. Which is correct?

I think it matters for us, because either both applications have ended up at Lee's Summit, or both applications have ended up at Overland Park, where they will be sitting awhile longer. Or maybe, just maybe, they have not been joined because they didn't want to send a K3 to Overland Park, where they know it will be sitting idle for 4 months.

This issue is potentially important for others as well. Because if we know the I130 gets sent to the I129f to be joined, and not the other way around, and you get a bad deal with where your I130 ended up, then it would make sense applying for a K3 visa even though it's supposed to be obsolete, just to get that I130 out of the stagnant pile and back in business. Follow?

Any thoughts on this would be appreciated!

To start with the semantics, I-130 and I-129F are not application forms, they are petition forms. Secondly, applying for a K3 visa only occurs at the Embassy/Consulate level, not at the USCIS level.

To the broader scope of the discussion, USCIS procedure since 2006 was to join the two petitions together. When this was done at service centers, the I-130 was pulled from the queue and placed with the I-129F that was just submitted. Since the the NBC and local offices became involved with adjudicating I-130 petitions it's been hard to say. One member had an I-129F filed to start the K3 process make it all the way to the Consulate only to have the Consulate administratively close it because they became aware an approved I-130 arrive on station at a later time. Then there is another recent report of an I-130 being called back from a local office. Logic dictates that once the new facility in KS is up and running, the procedure of pulling the I-130 from its current place in the queue and placing it with the I-129F that was just submitted will be the norm again.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

happy.png Thank you both so much for your help Ryan and Darnell. That is exactly what they did. Moved our I-130 to where the 129F resides at in Lee's Summit, and now they are both together. We fit 2 of the catagories to be expidited, so hopefully we will hear something soon! dancin5hr.gif We filed the 130 in May and the 129 in June. I pray everyday brings us closer.

such a painful and confusing process. We did the same as you did bukerjw. I've heard mixed reviews; some discouraging, like our I-129f will pull the I-130 out of line for them to join and potentially cause a further delay with I-130 processing. Also heard that it's a waste of time to file for a K3 and that they're not really processing those now. Would be good to hear some good news on this particular front.
