Expedite for the i-130

I have begin to do some research on expediting cases and have some questions.

With the situation in Egypt I have been wondering if we would qualify under the humanitarian situation. My husband doesn't really even go out unless it's necessary because of all the protests and is worried about the violence. He lives close to Tahrir square and has been called to not come into work many times since June 30 because of the risks to his safety.

The company my husband works for is also in what he calls a financial crisis. None of the employees have been paid in over a month and there is currently no solution in the works. Perhaps we could qualify for financial circumstances or does it have to be the petitioner who is having financial problems?

Does it make sense to try and apply for an expedite or could it do more harm than good somehow?

08/16/13 - Sent emails to both state senators and mailed a letter to state congressman.
08/21/13 - Call from congressman that letter is being forwarded to a different congressman. Mailed letters and evidence of situation in Egypt to senators
08/27/13 - Was told the congressman's office would make an inquiry about our expedite.
08/29/13 - Received e-mail that my congressman's office had filed their own expedite on our behalf on Tuesday and would notify me when they hear anything from the NBC.
08/30/13 - NBC responded to congressional inquiry. Could not give a date of predicted approval, but our inquiry was handed over to the expedite team for review and a decision.
09/04/13 - EXPEDITE APPROVED!

You CAN, but honestly the case is weak.

For the financial side, if your husband moves to the US without secure US employment, how will that help the petitioners financial situation? It will actually make it worse as the bills will double without an additional income. What is preventing him from getting another job? Or a second job? Why is he still working for the company if he is not getting paid?

For the humanitarian, I've only seen it where the beneficiary's life is in direct danger. Yes, the situation in Egypt is not good, but can he move? stay with friends in a safer part of the country? There are options available to him.

A denied expedite will not harm your case, it will mean that other cases will not be approved in a timely manner because the adjudicators need to stop and review yours, if everyone filed an expedite, no regular cases would ever get approved

Timeline

To qualify you have to show personal need. For example there are bombings all the time in Nigera but most people are not in the area. To actually qualify you would need to show a pattern basically at your husbands doorstep.

This will not be over quickly. You will not enjoy this.

Ironically I literally just got off the phone with a tier 2, asking for an expedite request for humanitarian reasons. They send you a letter in the mail, and you can write out exactly why you think you should receive it. It is read by a higher up person and If it is deemed worthy by the almighty adjucator god you will get it moved forward. I also asked about current processing times and they estimate it to be 9 months now. Had we been able to apply in january it would of been done already. But since I applied in may I have to wait til the new year? The logic of this process never ceases to astound me. Anyways, I am going forth with the process and see what I can do. The situation in egypt right now is awful and no loved one should have to deal with the MB holding the whole country hostage.

I filed in April so possibly in the same boat waiting until the new year. The clashes have been very close to where my husband lives and they have even spread to the streets below the family apartment at times. I think I will look into an expedite a little more.

Timeline

I think when the embassy plans on closing for the next month that no expedites will be given because the embassy is closed and cannot process interviews at this time

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

I just saw your timeline and I was wondering if you have completed your case at NVC?

If you have, did you get an interview from the embassy in Egypt yet?

Yes you can qualify.I have done it my self and elhamdullah it was approved. You actually have a big chance

Did you email NVC ?
