also are you folks taking the election to file as MFJ and complete the W7 and write a letter signed by both parties to treat the beneficiary like they are a US resident, and once you do that, if you need the requirements you can either run your taxes to have foreign income exclusion or take a foreign tax credit, spedially if you are transferring money in/out of retirement accounts, etc. quite tricky, just be sure to consult with someone who knows the rules of but the US (obviously) and also the foreign country regarding tax implications and whatnot.

thats all.

Yeah I had to do that (the foreign income exclusion/ tax credit) for the past 4 years since I was living and working in India but still had to file here in the US. Its honestly not that hard to do (I always do my taxes myself) just this year I actually have US income and its hubby's who is the foreign earned!

I didn't even look at head of household since I always did MFJ or single but maybe I will see if HOH gets me a better refund than MFJ since I just printed our but haven't mailed them yet!

ok..here's MY tax question....according to my income tax, I support my TWO girls...one because I do, the other, because she's a full time student so they consider her a dependant. But I really don't support her max...she works, files her own taxes also etc. so she counts? I make about 27000 AGI ...im sure im gonna have to find someone to file the 864(?) for me...id rather not but Im pretty sure I will. Question, does anyone know if i can get a F1 or J1 student visa while my i130/CR-1 is pending? I ask as I want to do an exchange to finish my research, however as I am not going as a "tourist" I need the student visa....

Have you tried asking in the forum here: http://www.visajourney.com/forums/forum/142-student-exchange-visitor-visas/?

Hi I am an August filer for my husband and sons. We all reside in Canada. My PD is August 29th if I can be added to the timeline. Our petitions are of course at NBC will they transfer even though I am an American born abroad and we are all residing in Canada? Thanks for any insight.

I believe everyone gets transferred out of NBC. And be sure to start preparing proof that you will have 'domicile' in the US. Just type in 'domicile' in the search box above, and you'll get plenty of threads to read.

Lisa, to be honest i never really looked at the schedule for poverty guidelines, but based on "house hold size" not sure how dependents play into this. Does it go based on who is registered to that address? or by the number of people you are "sponsoring" aka financial responsible for. as a backup may not hurt to have someone who can be a joint sponsor/co sponsor to ensure there are no issues should they bring it up (either at the NVC stage or the interview stage)...

If I were you, I'd start reading the NVC thread, as they tend to discuss the I-864 quite a bit, and should be helpful with answering some of your questions.

You also previously asked about 'what's next' essentially... that thread will really inform you on what you should know:

Actually last night I was so damn upset I barely got the chance to fully enjoy my good news. My doctor is "transferring" me COMPLETELY over to high risk docs. Which means MY doctor wont' deliver my baby, and I cant deliver my baby in MY hospital...I cried for hours..so much that I didn't even see the text right away. Im still very sad and i'll be begging the doctor later to give me one more week to try and get in the clear after all these new meds hes putting me on before he transfers me. So last night..that word transfer was SO bad before it was good unfortunately!

Hi all,

Just some random observations.

To note I don't necessarily think our VJ community data is a perfect random sample. However considering the distribution of dates and variety of beneficiary's countries I am going to assume for the sake of argument it is. Focusing on CSC.

Based on dashboard data and our tracking sheets:

July - 46042 Imm Family I-130 receipts

- CSC - 61 % = ~28000 of those 85% are approved or in RFE (46/55). Most of these were done within a month.

- Taking from this that July is almost done at CSC, few resources still to handle the remaining July but mostly onto Aug.

Aug - 44521 Imm Family I-130 receipts (22 working days - ~2025 per Day)

- Jan 22/29 : 1 Day worth of transfers about at CSC VJ 100% Complete (~2k)
- Jan 28 : 1 Day worth of transfers to TSC approvals still pending (~2k)
- Feb 3 : 5-6 days of transfers .. (~11K)
- Feb 6: 3 days of transfers .. (~6K)
- About 17k pending at CSC, with another 23k yet to be transferred.
CSC did ~27k adjudication per month consistently before they were moved to DACA. Now considering the focus on I130s and the fact that K1 129Fs have been mostly cleared prior to 130 transfers, I expect them to be doing 30 to 35K per month. I expect them to churn through the Aug transfers they already have and anticipate most will continue to be transferred to CSC. Within a month from today Aug should hopefully be 85 to 90% complete. At least I hope....

What you are saying makes sense! I just would be so happy to get an approval before I leave to visit my hubby in India! That would be the best case scenario to me at this point!
