big mistake-last name change on AOS forms

Hello

I've read here in vj that I can change my last name to my husbands while AOS-ing if I submit the paperwork with the new name..ok but I didnt know about one very importanat detail-my new last name must be on our marriage certificate. Instead I have my maiden name..itsnot a problem for me to file in my own last name and keep it .the problem is that i hve my I693 filled out signed and sealed in my husbands last name..what do i do now???do I send the rest of the forms with my name on them and just the i693 with my husbands,and just write an explination letter about this name situation? Any suggestions are appreciated!!!

It's still not a problem. USCIS accepts a marriage certificate as proof of name change, if you indicate you want it changed (which you did). Keep everything in married name, if that's the name you want.

And thank u for the quick reply..I was scared that they need the marriage certificate to be in the new married name as a proof of name change .. thank you

I misunderstood your reply,and I think you misunderstood my qiestion...on our marriage certificate I don't have my husbands last name therefore I can't use it as a proof of name change...I did not know that in order to file my aos package in my new married name my marriage certificate has to show it..how do I send the papers in now??

My wife's marriage certificate and most of the ones I have seen while doing Genelogy research has the name of each spouse listed as to what each spouse was using prior to marriage. It is a document that shows Joe Smith married Jane Doe on March 1, 2013 and is properly signed. Now if the wife wants to use her husband's name she shows that Jane Doe is married to Joe Smith and now wants her name to be Jane Doe Smith and so it becomes that. I do not know many Marriage Certificates that put the husband's last name on the woman. What if she wants to use her maiden name instead of her husband's? Taking the husband's last name is still a choice in this country and it is up to the woman to make that choice and the Marriage Certificate is used to show her maidne name before the marriage and her married name after the marriage.

You complete the AOS with the name you want on your GC. If you want your husband's name then put that on the first part and put your maiden name in the "Other names used" section. Since you are including a Marriage Certificate with the AOS application, that acts as the offical name change document. It does this because you are marreid to Joe Smith and want to now make your name Jane Doe Smith instead of Jane Doe. Or if you want to keep your current middle name you can do that too. I am sure the Marriae Certificate would work the other way too if your husband wanted to take your last name. He would use the Marriage Certificate to now be known as Joe Doe instead of Joe Smith. But the name you used before marriage has to be on the document to keep the trail complete on what names you have used.

Hey Dave a quick question. So we just registered our marriage and I am planning to send all my docs to USCIS. My wife who is a US citizen wants to change her last name . So dilemma is that should we change it before sending the docs to USCIS or after we get our GC approved. I don't want to delay the process and I don't want any confusion either. If my wife goes to change her name , It will probably take atleast 2 weeks ( Driving L , SSN Card, passport ) . Your suggestion is highly appreciated.

As a USC, she has a much easier time changing her lastname. Why would her changing her lastname have any affect on YOUR GC? Just have her fill out the form using her married name and sign it with that name. She can begin using her married name as soon as she is married--that is what the Marriage Certificate is for. She can then go to the SSA with the Marriage Certificate and get that changed and the DL as you have mentioned. I would complete the Part 3 B of the AOS with her married name.

hi dave just want to asked coz in my marriage cert i accidentally followed the american naming convention where in i retained my maidens middle name and i want it to be in filipino naming convention where in i dropped maidens middlename and change it in my dads surname as my middle name and last name of my husband last name can i change my middle name wen i filed AOS even though my marriage cert was writen in american naming convention
