Hi folks,

My wife (US citizen) and I are about to file our I-130 petition for me (UK citizen) to be able to apply for a CR1 visa to live with her in the US permanently.

I'm wondering if I can visit her and her family for short (1 week/2week/christmas) visits whilst waiting for approval? I don't have a tourist visa. I just have a passport and I am on he visa waiver program. I've tried researching it but most of the results are to do with people visiting on a tourist visa. etc.

Yes you can visit. There is a pinned thread full of experiences in the K1 visa forum. It applies to people on the spouse visa path too.

Hey Luca,

I did the I-130 too and visited my husband in the US during the process.

Just be sure to take evidence of ties to the UK, letter from your employer, rental agreements, return flight ticket etc. To be honest I took as much evidence with me as I could and wasn't asked for anything, but you just never know what the immigration officer will do.

I don't think you'll have any problems at all, just be prepared in case they ask for the evidence you'll return home to the UK.
